| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 22, 2008, following the Public Hearing of the same date, voted to approve certain alterations at the subject premises, as put forward in your application completed on November 28, 2007, as you were notified in the Status Update Letter issued on January 23, 2008 (SUL 08-6572, LPC 08-1851). The approval will expire on January 22, 2014. The proposed work, as approved, consists of the construction of a one-story rooftop addition located in the middle of the roof, clad with glass and aluminum window and door assemblies, cement stucco, with a metal fascia, wood trellises and fences, and a green roof; as shown in LPC-1, LPC-13, LPC-14, LPC-15, LPC-16, LPC-17, LPC-18, LPC-19, LPC-20, LPC-20a, LPC-20b, LPC-21, and LPC-22, undated, prepared by Gerry Smith, submitted as components of the application, and presented at the January 22, 2008 Public Hearing. In reviewing this proposal, the Commission noted that the Tribeca East Historic District designation report describes 45 Lispenard Street as a Renaissance Revival style store and loft building designed by Cady, Berg and See and built in 1895-96; and that the building's style, scale, materials, and details contribute to the special architectural and historic character of the Tribeca East Historic District. With regard to the proposal, the Commission found that the proposed rooftop addition will be minimally visible from the public thoroughfare and will be seen in the context of a roofscape with an existing bulkhead and water tower; that the proposed rooftop addition will be set back from the front and rear facade, maintaining the original volume of the building; that the height and massing of the rooftop addition will not overwhelm the building or the streetscape; that the proposed rooftop addition will be simple in design and massing and will be in keeping with the form and massing of the building and typical historic rooftop accretions in the Tribeca East Historic District; and that the material, fenestration and details of the addition will be in keeping with the character of rooftop accretions on the building, and will allow it to blend unobtrusively with the roofscape. Based on these findings, the Commission determined the proposed work to be appropriate, and voted to approve it. However, the Commission made its determination subject to the stipulation that final signed and sealed Department of Buildings filing drawings for the approved work be submitted for review and approval. Subsequently, on January 29, 2008 and April 2, 2008, the Landmarks Preservation Commission received final drawings F-000, F-001, F-100, F-501, and F-502, dated 11/18/07, drawings D-100, D-101, F-101, F-500, F-503, F-600, F-601, F-602, F-603, F-700, dated 10/15/07, and drawings A-800, A-801, A-802, A-803, A-804, A-805, A-806, A-807, A-808, dated 3/31/08, all prepared by Gerald Alfred Smith, R.A., drawings S-100, S-101, and S-102, dated 11/18/07, and drawing S-103, dated 10/15/07, all prepared by Anthony Gennaro, P.E. Staff reviewed these drawings and found that the approved work has been maintained in the filing drawings. In addition, staff noted the inclusion of the following additional work: interior alterations at the ninth floor; the installation of two new lot line windows at the ninth floor on the west façade; the expansion of the roof deck consisting of concrete pavers, wood fences, and planters; the removal of six two-over-two double-hung arched-headed wood windows at the Lispenard Street façade, and their replacement with six two-over-two double-hung arched-headed wood windows painted black; the removal of four two-over-two double-hung wood windows at the visible rear facade, and their replacement with four two-over-two double-hung aluminum windows painted black; and the removal of one one-over-one fixed wood window at the visible rear facade, and its replacement with one one-over-one fixed aluminum window painted black. With regard to these changes, the Commission finds, in accordance with the Rules of the City of New York, Title 63, Section 2-19(e)(1), that the new deck, fences, and planters consist solely of mechanical equipment; will not result in damage to, or demolition of, a significant architectural feature of the roof; will not be visible from a public thoroughfare; and will not adversely affect significant architectural features of adjacent improvements. The Commission also finds, in accordance with the R.C.N.Y., Title 63, Section 3-04(c)(2), that the new windows at the Lispenard Street façade will match the historic windows in terms of configuration, operation, details, material, and finish. The Commission further finds, in accordance with the R.C.N.Y., Title 63, Section 3-04(d), that the new visible windows at the rear façade will match the historic windows in terms of configuration and finish. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-8981 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
