| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 25, 2008, following the Public Hearing and Public Meeting, voted to grant a Certificate of Appropriateness approving alterations to the roof and rear yard and denying the raising of attic windows, as put forth in your application completed on February 25, 2008. This permit will expire on March 25, 2014. The work, as approved, consists of constructing a dormer on the front face of the gable roof which would be visible from within Washington Square Park; excavating the rear yard, constructing a cellar addition, and re-landscaping the rear yard. The proposal as originally presented called for increasing the height of the attic windows at the front façade. This work was shown in photo boards and drawings 1, 1b, 2, 3, 4, and 5, dated March 25, 2008, prepared by Turett Collaborative Architects and submitted as components of the application, and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District designation report describes 109 Waverly Place as a Greek Revival style house built in 1840; and that in terms of its style, scale, materials, design, and details the building contributes to the special architectural and historic character of the Greenwich Village Side Historic District. With regard to this proposal, that the proposed work will not cause damage to, or demolition of, any significant architectural feature; that the proposed dormer will be minimally visible over the primary façade of the building from within Washington Square Park, and will be in keeping with typical historic rooftop accretions in the district in terms of its visibility and design; that the height and volume of the proposed dormer, stair bulkhead, and roof deck will not overwhelm the scale of the building; that the proposed alterations to accommodate the proposed rooftop stair bulkhead, dormer, and deck will be minimal, thereby maintaining the original volume of the building; that that the proposed alterations to the pitched roof will not detract from the silhouette of the roofline or the architectural character and features of the rear façade; and that most of the original existing roof pitch will remain, which will retain the scale and character of the building. that the excavation will be set back from the sides of the rear yard, minimizing the impact on the surrounding buildings; that the cellar extension, with a structural skylight set flush with the rear yard paving, and a substantial planted area, will maintain the presence of a rear yard; and that the adjacent rear yards exhibit a variety of grades, therefore the proposal will not be out of character. Based on these findings, the Commission determined these aspects of the proposed work to be appropriate to the building and voted to approve it. With regard to attic windows at the front facade, the Commission found that enlarging the windows will alter the building's original proportions on the front facade. Based on this finding, the Commission determined the work to be inappropriate to the building and to the historic district and voted not to approve it. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that the window alterations be omitted; and that two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and approval. Subsequently, on April 2, 2008, the staff of the Commission received drawings A-000, A-001 through A-004, A-006, A-007, A-100 through A-107, A-200, and A-210 throguh A-213, dated March 28, 2008, prepared by Wayne Stefan Turrett, R.A.; and S-1, dated February 2008, prepared by Mikhail B. Gurvich, P.E. The Commission staff noted that the drawings included additional work including, interior alterations at the cellar through 4th floor, including the demolition and construction of interior non-bearing partitions and finishes, including upgrading the plumbing, electrical, and mechanical systems. The Commission reviewed the submitted drawings and found that proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. The Commission further notes that the proposed work has the potential to impact mid-19th century archaeological resources adjacent to the original rear façade. Therefore, archaeological monitoring shall be completed as part of the excavation of this area which means that an archaeologist is present for this portion of work and can stop the construction excavation in the area to determine if any archaeological resources are present. In the event that such resources are uncovered, the archaeologist shall: (1) notify Amanda Sutphin, Director of Archaeology (212) 669-7823, about the discovery; (2) in consultation with LPC determine how to appropriately document what has been uncovered such as by measuring, drawing, and photographing the potential cistern and excavating a sample of its contents; and once the on site archaeology has been finished: (3) complete any needed analysis of artifacts that are found as well as clean and inventory them (4) complete historic research to determine who the resource was associated with and (5) complete an archaeological report detailing the work that was completed and noting what has been learned. This work shall be completed by a professional archaeologist as per the 2002 LPC Archaeology Guidelines of New York City. In the event that nothing is found, the archaeologist shall prepare a memo detailing their work. The report or memo shall be submitted to the LPC for review and approval. Construction may proceed if nothing of significance is found or as soon as a discovery is documented by the archaeologist at the site. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately.
