| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 25, 2008, following the Public Hearing of February 26, 2008, voted to approve a proposal for work at the subject premises, as put forward in your application completed on March 20, 2008, and as you were informed in Status Update Letter 08-8359, issued on March 25, 2008 (LPC 08-4996). The approval will expire March 25, 2014. The proposed work, as approved, includes the removal of masonry at the ground floor Water Street elevation and combining two existing masonry openings to create one large opening with a concrete lintel to match existing; the installation of glass and steel storefront painted forest green color with multiple fixed lights, a lit logo reading "Dumbo Space", and a double leaf wooden door; the installation of a green painted steel awning with recessed lighting and lit steel logo reading "Dumbo Space"; the removal of three metal doors at the first floor of the Water Street elevation and the installation of two metal doors painted forest green with fixed single light transoms, and one glass and metal framed door with a fixed single light transom, all within existing masonry openings; the construction of a one story rooftop addition, a stair bulkhead, and a elevator bulkhead clad in brick with three paired, and one single glass and metal framed doors, exterior lighting, a metal ladder and railing leading to the roof at the Water Street elevation; and four paired glass and metal framed doors at the rear elevation. The proposal was shown in historic photograph and existing condition photographs, photo montages and revised drawings dated February 2, 2008, prepared by Ekaterini Christodoulou, R.A., submitted as components of the application and presented at the Public Meeting and Public Hearing. In reviewing this proposal the Commission noted that the DUMBO Historic District designation report describes 192 Water Street as an American Round Arch style stable designed by Edward N. Stone and built in 1898; and that the style, scale, materials, and details of the building are among the features that contribute to the special architectural and historic character of the DUMBO Historic District. Staff further notes the building stock within the historic district consists primarily of large, multi-story factory and warehouse buildings representing important trends in the development of industrial architecture in the United States during the 19th and 20th centuries; and that today there is a mixture of uses and many buildings have been altered to accommodate the new uses. With regard to this proposal, the Commission found that the ground floor has already been altered, resulting in the loss of the original openings, and the proposed work will involve the removal of only a minimal amount of brick; that the enlarged ground floor opening will be in keeping with large ground floor openings found on buildings that have been adaptively reused throughout the historic district; that the proposed multi-light infill will evoke in a contemporary way garage or stable doors, and will relate to the industrial character of the streetscape, and is evocative of canopies and garage doors found throughout the historic district; that the proposed metal canopy will relate to canopies found throughout the district; that the addition as viewed from the rear will be visible in the context of other additions and roof top accretions along the street; that the presence of a visible one-story rooftop addition will be in keeping with the skylights, mechanical, and other industrial related rooftop additions that features found on buildings in the district; and that the addition has been clad in a material that will relate well to the building and other additions in the district. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the DUMBO Historic District, and voted to approve this application. However, in voting to grant this approval, the Commission stipulated that the floor to ceiling height of the rooftop addition be reduced, and that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on March 28, 2008, the Landmarks Preservation Commission received three final drawings dated February 12, 2008, labeled 1, 2 and 3, and prepared by Ekaterini Christodoulou, RA. Accordingly, staff reviewed the drawings and found that the approved proposal has been maintained and that the proposal has been revised to include additional work. The work also includes the removal of one-over-one, double hung metal windows at the second through fourth floors of the Water Street elevation and the installation of four-over-four, double hung wood windows finished in forest green paint; lowering the sashes of eight windows at the third and four floor rear elevation and the installation of single-light glass and metal double doors with a divided light fixed transom and a 3'4" steel railing; the removal of two three-over-three, double hung wood windows at the second floor rear elevation and the installation of two square awning windows with the remaining masonry opening patched with brick to match the surrounding masonry; the removal of three-over-three, double hung wood windows and one divided light transom at the first floor rear elevation and patching the masonry openings with brick to match the surround masonry; the removal of a metal door at the first floor rear elevation and the installation of a smaller dimensioned metal door with the remaining masonry opening patched with brick to match the surrounding masonry. With regard to the proposed replacement windows, the Commission finds, in accordance with the provisions set forth in Title 63 of the Rules of the City of New York, Section 3-04(c)(1) and 3-04(d)(2) that the proposed primary elevation windows will be installed within existing masonry openings and match the historic windows in terms of configuration, operation, material, details, and finish; that the proposed enlarged masonry openings at the rear elevation will not alter or destroy protected features; that windows being removed are not "special" windows as defined in the definitions (section 3-01) and illustrated in Appendix A; and that the proposed brick infill at the first and second floor rear elevation will not be visible from the public thoroughfare. Based on these and the above findings, the Commission determined the work to be appropriate to the building and the DUMBO Historic District. The work, therefore, is approved. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-8781 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual PAGE 2 Issued: 3/25/08 DOCKET: 08-7681 building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
