| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 25, 2008, following the Public Hearing of the same date, the Landmarks Preservation Commission voted to approve a proposal to alter the fire escape at the subject premises, as put forward in your application completed on March 20, 2008, and as you were informed in Status Update Letter 08-0363, issued on March 25, 2008 (LPC 08-5938. This approval will expire on March 25, 2014. The proposed work, as approved, consists of the removal of a single bay fire escape and the installation of a two bay fire escape with decorative metal detailing. The proposal was show in historic photographs, existing condition photographs, and drawings dated March 13, 2008, prepared by Paul A. Castrucci, architect, submitted as components of the application and presented at the Public Hearing. In reviewing the proposal, the Commission noted that the Soho-Cast Iron Historic District designation report describes 317 Canal Street as a Federal style house built in 1821 and altered in 1869; and that in terms of its style, scale, materials, and details, it contributes to the special architectural and historic character for which the Soho-Cast Iron Historic District was designated. With regards to the proposal, the Commission found that that the existing fire escape is not decorative in nature and the alterations will not result in the removal of significant architectural fabric; that the proposed fire escape will match the design, details and size of the historic fire escape located on adjacent, similar buildings; that the enlargement of the fire escape is necessitated by current safety regulations, and in keeping with the history of the building; that there is an existing fire escape on this building and the presence of fire escapes is consistent with the historic development and character of this historic district; and that the installation of a larger fire escape will not detract from the special historic and architectural character of the building or of the historic district. Based in these findings, the Commission determined the proposed work to be appropriate to the building and the Soho-Cast Iron Historic District, and voted to approve the work. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff at the Commission for review and approval. Subsequently, on March 26, 2007, the Landmarks Preservation Commission received final drawings LM1, LM2 and LM3, dated March 13, 2008, and prepared by Paul A. Castrucci. Staff reviewed the drawings and found that the work approved by the Commission has been maintained. The work also includes the removal of one-over-one, double-hung metal windows and the installation of two-over-two, double-hung wood windows within existing masonry openings at the primary Canal Street elevation; the removal of a first floor aluminum and glass residential entrance door and the installation of glass and wood paneled door and fixed transom light; and the installation of a rooftop railing. With regards to this addition work, the staff finds, in accordance with the provisions set forth in Title 63 of the Rules of the City of New York, Section 3-04 (c)(2)(i), that the existing windows at the primary elevation are not historic; and that the proposed replacement windows will match the historic windows in terms of configuration, operation, details, material and finish. The Commission further finds, in accordance with the Rules of the City of New York, Title 63, Section 2-19(e)(1), that the proposed rooftop installation consists solely of mechanical equipment; that it will not result in damage to, or demolition of, any significant architectural features of the roof of the building; that the railing will not be visible from any public thoroughfares. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-8746 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
