Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of March 4, 2008, following the Public Hearing and Public Meeting of
December 18, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises,
as put forth in your application completed on November 19, 2007.

The work, as approved, consists of the construction of a rooftop pergola at the south west corner of the building
closest to the intersection of Fifth Avenue and 62nd Street, with arched framing members fabricated of metal
painted a gray/tan, similar to the color of the stone cladding on the adjacent facades, and secured to a new roof
deck, with the deck set behind the existing balustrade and not visible from the street, as shown in drawings LM01
through LM07, all hand-dated March 4, 2008, and a cover sheet printed on march 4, 2008, including a block plan,
plans and sections of the existing terrace and proposed pergola, photographs of the building and a mock-up
constructed on site, and of pergolas on other buildings, and a photo-montage showing the pergola in place, all
prepared by Halsted Welles Associates Inc., and presented at the Public Hearing and the Public Meetings. As
originally presented in December, the pergola was taller, with a different pattern of arched framing members, and
with a black finish, as shown in drawings LM01 through LM09, dated November 8, 2007.

In reviewing this proposal, the Commission noted that the designation report describes this building as a
neo-Italian Renaissance style apartment building designed by J. E. R. Carpenter and built in 1925-26; and that the
style, scale, materials, and details of the building are among the features that contribute to the special architectural
and historic character of the Upper East Side Historic District

With regard to this proposal, the Commission found that the that the proposed work will not cause the destruction
of any significant historic material; that awnings, lattice screens, and pergolas are frequently seen at the
penthouses and setbacks on buildings of this age and type in this historic district; that the slim profile of the
framing members will reduce the pergola's visibility; that the gray painted finish will help the pergola to blend in
with the existing stone cladding and minimize its visibility when seen against the sky; that the pergola will be set
far enough behind the balustrade on the Fifth Avenue facade to minimize its impact when seen from the west and
Central Park; and that for these reasons the construction of a pergola on this terrace will not diminish the
building, the streetscape, or the Upper East Side Historic District. Based on these findings, the Commission
determined the proposed work to be appropriate to the building, and voted to approve it.

On March 17, 2008, the staff of the Commission received drawings DE01, DE02, and DE03, all dated March 17,
2008, prepared by Halsted Welles Associates Inc. Staff has reviewed these materials and finds that the proposal
approved by the Commissioners has been maintained in the filing drawings. Based on this and the above findings,
these drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 08-8260 is
being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
displayed at the site while work is in progress. Please direct inquiries to John Graham.
