Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of March 11, 2008, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed on February 14, 2008, and as you were informed in Status Update Letter 08-7960 (LPC
08-5393), issued March 11, 2008.

The proposed work, as approved, includes installing a new fiberglass cornice painted cream ("Pale Rider"
141GN) at the parapet, as shown in drawings and photographs labeled A1, A2 and A3, dated February 28, 2008,
prepared by FSI Architecture, submitted as components of the application and presented at the Public Hearing
and Public Meeting.

In reviewing this proposal, the Commission noted that the designation report states that 77 Mercer Street is a store
and loft building designed by Jesse W. Powers and built in 1875-76; and that the scale, style, details and materials
of the building are among the features which contribute to the special architectural and historic character of the
SoHo-Cast Iron Historic District. The Commission further notes that the original cornice, with an arched center
section, was removed prior to designation.

With regard to this proposal, the Commission found that the installation of a cornice on the building will return
an important architectural feature to the building and will provide the facade with a stronger termination; that the
proposed cornice, while not a replica of the original, features elements such as curved brackets in two different
sizes, that will recall some of the decorative details of the original cornice, and its design, scale, color and
ornamentation will complement the Italianate-style details of the building; and that the work will enhance the
special architectural character of the building, the streetscape and the historic district. Based on these findings, the
Commission determined the proposed work to be appropriate to the landmark, and voted to approve this
application.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two signed and sealed copies of the final drawings for the approved work to be submitted to the Department of
Buildings.

Subsequently, the staff of the Commission received drawings A0 through A3, dated February 28, 2008, prepared
by FSI Architecture. The Commission reviewed the drawings and found that the proposal approved by the
Commission has been maintained. Based on this and the above findings, the drawings have been marked
approved by the LPC with a perforated seal and Certificate of Appropriateness 08-8092 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
