Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 8, 2008, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for work at the subject premises, with modifications, as put forward in your
application completed on December 13, 2007; as described in Status Update Letter 08-6229 (LPC 08-2882)
issued on January 8, 2008.

The proposal, as approved, includes the installation of a wood pergola with flat roof and privacy fencing, all
painted light grey, at the 15th floor terrace at the secondary east elevation. The proposal, as originally presented,
called for a pitched roof and a different configuration for the privacy fencing. The proposal was shown on
presentation boards consisting of a historic district map, current condition photographs, mock-up photographs,
and elevation and plan drawings, dated received January 2, 2008, prepared by Halsted Welles Associates, all
presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the designation report describes 35 East 75th Street as an
apartment building designed by Paul Resnick and built in 1958.

With regard to this proposal, the Commission found that the building is not one of the buildings for which the
Upper East Side Historic District was designated; that the proposed pergola and privacy fence, consisting of
lattice work articulated in squares, although visible, will be seen in relation only to the building's secondary
façade; that the flat roof of the pergola is in keeping with the horizontal lines of the building's architecture; that
the pergola and privacy fence will be viewed well above the roofs of neighboring low-scale buildings, and
therefore will not draw undue attention away from the significant features of other buildings within the historic
district; and that the pergola and fence will be finished in a light grey color and will therefore blend with the color
of the brick on the building, and be less perceptible. Based on these findings the Commission determined the
work to be appropriate to the building, the streetscape, and the Upper East Side Historic District, and voted to
approve this application.

However, the Commission made its determination subject to the stipulation that the pergola have a flat roof, and
that two sets of signed and sealed Department of Buildings filing drawings be submitted to the Commission for
review and approval. Subsequently, on March 12, 2008, the Commission received drawings BD00, BD01, BD02,
and BD03, dated March 6, 2008, prepared by Allan Klein, R.A. The Commission reviewed the drawings and
found that the changes requested by the Commission have been incorporated into the proposal. Based on this and
the above findings, the drawings are being marked approved with a perforated seal, and Certificate of
Appropriateness 08-7812 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
