Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of November 22, 2005, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on October 27, 2005, and as you were informed in Status Update Letter 06-4059 (LPC 06-2910), issued November 28, 2005. The proposed work, as approved, includes removing an existing pair of 9' high metal doors at the East 53rd Street alley at the rear of the Seagram Building, and installing a 40' high enclosure at the alley consisting of a pair of bronze doors surmounted by a bronze louver, and set back approximately 14' from the East 53rd Street façade, as shown in drawings labeled "New Alleyway Door", and "New Proposed Alleyway Door at 53rd Street," dated November 2005, prepared by Foster and Partners, submitted as components of the application and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that 325 Park Avenue, the Seagram Building, is an International style office building designed by Mies van der Rohe and built in 1955-1959. The Commission further noted that this permit is being issued in conjunction with Modification of Use 07-5967 issued February 28, 2007 in support of an application for the issuance of a Special Permit, pursuant to Section 74-79 of the Zoning Resolution to permit the transfer of development rights from the building located at 375 Park Avenue to the property at 610 Lexington Avenue. With regard to this proposal, the Commission found that the material and finish of the new door and louver will be compatible with the materials and finishes of the landmark; that the utilitarian character of the door and louver are in keeping with their location at the rear of the building where mechanical equipment will be located; that the deep setback from the street of the door and louver will make them unobtrusive; and that the presence of the door and louver will not detract from the special historic and architectural character of the landmark. Based on these findings, the Commission determined the proposed work to be appropriate to the landmark, and voted to approve this application. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two signed and sealed copies of the final drawings for the approved work to be submitted to the Department of Buildings. Subsequently, the staff of the Commission received drawings D101, D201, A001, A101, A201, and A301, dated March 7, 2008, prepared by SLCE Architects. The Commission reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved by the LPC with a perforated seal and Certificate of Appropriateness 08-7949 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
