Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of September 19, 2006, following the Public Hearing and Public Meeting of
May 23, 2006, the Landmarks Preservation Commission voted to approve a proposal to construct a rooftop
addition and the replacement of the historic window sashes throughout the building with painted aluminum
sashes, as put forward in your application completed on April 27, 2006. The approval will expire on September
19, 2012.

The proposed work, as approved, consists of the construction of a rooftop addition; exterior work at the 23rd
Street, 24th Street, and Fifth Avenue facades, including the removal of single-pane bronze-clad wood pivot
windows at the second floor and replacement with single-pane aluminum tilt-and-turn windows painted Benjamin
Moore 1582 ("Deep River") at the second floor; removal of one-over-one, double-hung bronze-clad wood
windows and replacement with one-over-one, double-hung aluminum windows painted Benjamin Moore 1582 (
"Deep River") at the third through thirteenth floors; removal of bronze-clad wood double-hung windows in an
arched tripartite configuration with aluminum one-over-one double-hung windows in an arched tripartite
configuration painted Benjamin Moore 1582 ( "Deep River") at the fourteenth floor; exterior work at visible and
non-visible portions of the interior courtyard elevations, including removal of one-over-one, double-hung
bronze-clad wood windows and replacement with one-over-one, double-hung aluminum windows painted
Benjamin Moore 1582 ("Deep River") at the second through fifteenth floors; exterior work at visible and
non-visible portions of the west elevation, including removal of one-over-one, double-hung bronze-clad wood
windows and replacement with one-over-one, double-hung aluminum windows painted Benjamin Moore 1582
("Deep River") at the third through fourteenth floors and penthouse; as shown in a finish sample, existing
conditions photographs and drawings labeled LP.01, LP.02, LP.02M, LP.03, LP.03M, LP.04, LP.04M, LP.05,
LP.05M, LP.06, LP.06M, LP.07, LP.07M, LP.08, LP.09, LP.09M, LP.11, LP.11M, LP.12, LP.12M, L.12, L.13,
L.14 through L.17, L.21 through L.26, L.41 through L.43, L.81 through L.85, dated September 19, 2006,
prepared by Avinash K Malhotra Architects and Higgins & Quasebarth, submitted as components of the
application, and presented at the Public Hearing and the Public Meeting.

In reviewing this proposal, the Commission noted that 200 Fifth Avenue is a neo-Renaissance style store and
office building built in 1908-09, designed by Maynicke and Franke; and that the style, scale, materials and details
of the building are among the features that contribute to the special architectural and historic character of the
Ladies' Mile Historic District.

With regard to this proposal, the Commission finds, that the historic copper window framing will be retained and
that the new sashes will match the historic sashes in terms of configuration, details, color, and operation. Based
on these findings, the Commission determined the proposed work to be appropriate to the building and to the
Madison Square North Historic District. The work, therefore, is approved.

However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of
the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission
for review and approval.

Subsequently, on February 19, 2008, the Landmarks Preservation Commission received final drawings labeled
A3.00X, A3.00, A3.01X, A3.01, A3.02X, A3.02, A3.03X, A3.03, A3.04X, A3.04, A3.05X, A3.05, A6.20
through A6.24, and A7.00, dated revised February 13, 2008, and prepared by Todd C. Degarmo, R.A.
Accordingly, staff reviewed the drawings and found that the proposal has been amended to eliminate the
proposed rooftop addition from the scope of work. The Commission reviewed the drawings and found that the
proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings
are marked approved with a perforated seal, and Certificate of Appropriateness 08-7660 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
