Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 20, 2007, following the Public Hearing on October 23, 2007,
voted to approve the proposed work at the subject premises, as put forward in your application completed on
November 20, 2007, and as you were informed in the Status Update Letter issued on November 20, 2007 (SUL
08-5042, LPC 08-2129). This approval will expire on November 20, 2013.

The proposed work, as approved, consists of enclosing a balcony at the 12th floor, on the visible secondary north
façade by installing new aluminum windows set within the masonry openings; and alterations at the visible
secondary west façade including combining two window openings and installing a tri-partite aluminum window
finished in a gray color to match the previously approved windows elsewhere on the facade. The proposal, as
initially presented, included combining two pairs of window openings at the west façade, as shown in
photographs, photomontage, revised drawings A-000, A-001, EX-101, LPC-401, LPC-403, LPC-402, LPC-405,
LPC-406, LPC-407, LPC-408, LPC-410, LPC-411, and LPC-413 dated October 15, 2007, and revised drawings
A-101, LPC-402, LPC-404, LPC-409, and LPC-412 dated November 20, 2007, prepared by David Howell
Design, submitted as components of the application, and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Carnegie Hill Historic District Designation Report
describes 15 East 91st Street as a fifteen-story Modern style apartment building designed by Leonard Schultze &
Associates and built in 1946-47; and that the building's style, scale, materials and details are among the features
that contribute to the special architectural and historic character of the Carnegie Hill Historic District. The
Commission further noted that prior to designation, most of the open balconies at the corner bays were enclosed
by windows of various designs; that Certificate of Appropriateness 95-0052 was issued on October 13, 1994
approving a building-wide Master Plan for the installation of aluminum casement windows with a gray painted
finish; and that the Master Plan does not include the window openings at the balconies.
With regard to this proposal, the Commission found that the proposed balcony enclosure will match most of the
corner bays that have been enclosed at the north elevation, therefore providing a more uniform appearance and
fenestration; that the installation of the proposed balcony enclosure will not significantly alter the massing of the
building, and that the glazing will maintain a sense of transparency at the corner bay; that the proposed balcony
windows at the north elevation and enlarged window opening at the west elevation will closely match the
tripartite configuration and details of the master plan windows; that the window enlargement will be consistent in
terms of its size, configuration, and pattern of openings across the west elevation, emphasizing the horizontality
of the upper floors and establishing a regular pattern at this secondary façade; that the enlarged opening at the
west façade will match the existing lintel height of windows at the upper and lower floors and will therefore
maintain the relationship to most of the windows above and below; that the gray finish will match the previously
approved finish for the window replacement master plan; and that the proposed work is supportive of the special
architectural and historic character of the Carnegie Hill Historic District. Based on these findings, the
Commission determines that the proposed work is appropriate to the building and to the Carnegie Hill Historic
District, and voted to approve this application.

However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the
presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for
the approved work be submitted to the staff of the Commission for review and approval.

Subsequently, on February 14, 2008, the Landmarks Preservation Commission received final revised drawings
A-000, A-101, EX-101, LPC-401, LPC-402, LPC-405, and LPC-406 dated February 13, 2008, and prepared by
Terry Binnion Fuqua, RA. Staff reviewed the drawings and found that the proposal approved by the Commission
has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated
seal, and Certificate of Appropriateness 08-7643 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
