Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 14, 2002, following the Public Meeting and Public Hearing of June 26, 2001, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on May 24, 2001, and as you were informed in Status Update Letter 02-6513 (LPC 01-6084), issued May 15, 2002. The proposed work, as approved, includes constructing a one-story metal, glass and stucco rooftop addition with a stair bulkhead, as shown in photomontages, and drawings and photographs labeled LM.1, LM.2, and LM.3, received at the Commission May 2002, prepared by George Boyle, Architect, submitted as components of the application and presented at the Public Hearing and Public Meetings. The proposal, as presented at the Public Hearing and Public Meeting of June 26, 2001, featured a 10 inch higher addition and a one foot higher stair bulkhead, as shown in photo montages dated June 2001, prepared by George Boyle, Architect. In reviewing this proposal, the Commission noted that 323 Greenwich Avenue is a Renaissance Revival style store and loft building built in 1898 and designed by McIlvaine and Tucker; and that the style, scale, materials, design and details of the building are among the features which contribute to the special architectural and historic character of the Tribeca West Historic District. With regard to this proposal, the Commission found that the simple design, massing and materials of the proposed rooftop addition and stair bulkhead will allow them to read as utilitarian structures which are in keeping with the character of other rooftop additions in this historic district; that only a minimal amount of the addition will be visible in conjunction with the front facade from inside the park across the street; that the addition will be most visible above the roof of the adjacent building, where it will be seen in the context of other rooftop structures, with which it will blend in; that the light color of the addition will distinguish it from the dark cornices it will be visible above, and thus, it will not interfere with the existing roofline of this building, or the adjacent building; and that no significant architectural features will be altered or damaged by this construction. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission made its determination subject to the condition that the applicant submit samples of the metal cladding and stucco for staff review and approval. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two signed and sealed copies of the final drawings for the approved work to be submitted to the Department of Buildings, and the metal and stucco samples. Subsequently, the staff of the Commission received drawings A.0, BD.1, BD.3, BD.4, and D.1, revised April 17, 2007, and BD.2, A.1, A.2, A.3 and A.4, revised February 15, 2008, and revised photo montages, dated February 8, 2008, prepared by George Boyle, Architect, and a sample of tern-coated steel. The Commission reviewed the drawings and noted that the stair bulkhead is wider but further back on the roof and its orientation has been reversed so that the sloped side faces the front of the building; that an air-conditioning unit has been added to the roof in front of the stair bulkhead; and that the side walls of the addition that will be contiguous with the existing side walls of the building, will be brick instead of the proposed stucco. With regard to these changes, the Commission finds that revised photo montages show that the stair bulkhead, while wider than the approved, will be less visible from public thoroughfares due to the change in orientation and locating it further back on the roof; that the air-conditioning unit will be minimally visible from public thoroughfares; and that the brick used for the side walls will match the color, texture, dimensions and bonding pattern of the existing brick wall. The Commission further found that the material to be used for the standing seam metal cladding is a material found on utilitarian rooftop structures throughout the historic district; and that the proposal approved by the Commission has been maintained. Based on these and the above findings, the drawings have been marked approved by the LPC with a perforated seal and Certificate of Appropriateness 08-7472 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
