Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of December 18, 2007, following the Public Hearing and Public Meeting of
November 13, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject
premises, as put forth in your application completed on October 18, 2007.

The proposal, as approved, consists of window installations at the secondary eastern and western facades of the
42nd Street tower of the building, including removing existing plain buff-colored brick, set between historic
bands of darker color brown brick, to create additional new paired window openings, and installing new
black-finished three-over-three windows in the new openings, all as shown in drawings titled "42nd Street View",
"Neighbors", "Picture Location", "West Side", "Aerial View", "East View", "Close View", "Existing Approved
East Elevation", "Existing Approved West Elevation", "Proposed East Elevation", "Proposed West Elevation", a
typical floor plan, and window details, all prepared and presented at the Public Hearings and Public Meeting by
Perkins Eastman Architects LLP. As originally presented at the November 13, 2007 Public Hearing, the work
also included a proposal for alterations to the ground floor storefront infill, but that portion of the application was
removed from the proposal and was later presented at the January 15, 2008, Public meeting. The proposal for
window installation was not modified between November 13 and December 18, 2007.

In reviewing this proposal, the Commission noted that the designation report states that Bush Tower is a
neo-Gothic commercial building designed by Helmle and Corbett and built in 1916-18. The Commission also
noted that the building is comprised of a tower facing 42nd Street, and a lower wing extending through the block
to 41st Street; that the north facade of the tower, facing West 42nd Street, is a fully developed facade, with stone
mullions between the windows; that the east and west facades of the tower are secondary facades, with vertical
bands of decorative masonry to suggest stone mullions; that the east facade has an historic recess with windows,
and a small number of windows which were added prior to designation; that the west facade was constructed with
no windows, but also had several windows added prior to designation; and that this proposal would not alter the
recessed windows on the east facade, and would incorporate the existing windows on both facades.

With regard to this proposal, the Commission found that the proposed new window openings will create a regular
pattern which recalls historic window patterns found on secondary facades on many historic buildings; that the
paired window configuration will recall the paired configuration on the primary façade; that the new window
pattern has been designed to avoid damage to the special masonry, helping to integrate the new windows into the
historic facade; that the proposed windows at the corners of the tower up to the 21st floor will relate well to the
existing diagonally placed windows at the corners above the 21st floor; and that the locations of the elevator
banks and exit stairs on the east and west sides of the tower will prevent the addition of more window on these
facades, leaving a significant portion of solid masonry intact on each façade. Based on these findings, the
Commission determined the proposed work to be appropriate to the building, and voted to approve it.

In voting to grant this approval, the Commission made its determination subject to the condition that two sets of
signed and sealed Department of Building filing drawings for the approved work be submitted to the Commission
for review.

On February 14, 2008, the Commission received drawings A00, A01, and A12 through A16, all dated January 9,
2008, prepared and submitted by Perkins Eastman Architects. Staff has reviewed these materials and finds that
the proposal approved by the Commission has been maintained in the drawings. Based on these drawings and the
approved findings, Certificate of Appropriateness 08-7325 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
