Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of December 11, 2007, following the Public Hearing of the same date, the
Landmarks Preservation Commission voted to approve a proposal for the work at the subject premises, as put
forward in your application completed on September 6, 2007, and as you were informed in Status Update Letter
08-5722 (LPC #08-1967), issued on December 14, 2007. This approval will expire December 14, 2014.

The proposed work, as approved, consists of removing all of the deteriorated brownstone cladding at the primary
façade; installing a new cast stone facade to match the original masonry in color, dimension, detail, aggregate size
and shape; creating missing lintels at the second, third, and fourth floors, to match the original masonry. The
Commission viewed the presentation materials samples of original brownstone and cast stone, photographs of
present conditions and drawings, prepared by Edy Zingher, P.E., submitted as components of the application and
presented at the Public Hearing and Public Meeting.

In reviewing the proposal, the Commission noted that the designation report describes 48 Warren Street as a
Italianate style store and loft building built c.1855; and that in terms of its style, scale, materials and details, the
building contributes to the special architectural and historic character for which the Tribeca South Extension
Historic District was designated.

With regards to this proposal, the Commission found that the brownstone masonry units are displaced and deeply
eroded and cannot be consolidated or repaired by any other means; that the proposed cast stone will replicate the
original texture, color, profiles, and details of the brownstone; that the use of new masonry with pointed joints
will maintain a materiality that existed before the failure of the façade; that the flat detailing at the window lintels
will not restore the historic detail and will not be consistent with the Italianate style of this façade; and that the
work is supportive of the special architectural and historic character of the Tribeca South Historic District
Extension.

However, the Commission made its determination subject to the stipulation that missing ornamental lintels be
recreated and that two sets of signed and sealed DOB filing drawings, revised to incorporate these changes, be
submitted to the staff of the Commission.

Subsequently, on January 29, 2008, the Landmarks Preservation Commission received final drawings FR-1,
issued May 5, 2006, prepared by Edy S. Zingher, P.E. of Etna Consulting. Staff reviewed the drawings and
found that the restoration of the lintels is based upon existing physical evidence on the building, that the
restoration will not cause the removal of significant historic fabric that may have been added over time, and will
return these significant elements to their historic appearance. Based on this and above findings, the drawings are
marked approved with a perforated seal, and Certificate of Appropriateness is being issued.

This permit is contingent upon the Commission's review and approval of samples of cast stone, pointing, and
manufactured lintels replacements prior to commencement of work. Please contact Joselito Corpus to schedule a
site visit once samples are available for review. This permit is also contingent on the understanding that the work
will be performed by hand and when the temperature remains a constant 45 degrees Fahreneheit for a 72 hour
period from the commencement of work.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
