Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of November 18, 2008, following the Public Meeting and Public Hearing of November 13, 2008, voted to deny the removal and replacement of two bays of storefront infill and to approve the construction of a one-story addition at the rear elevation at the subject premises, as put forward in your application completed October 16, 2008. This approval will expire November 18, 2014. The work denied consists of the removal and replacement of the historic ground floor storefront infill on Madison Avenue. The work, as approved, consists of demolition of a portion of the rear façade at the second floor, and construction of a single-story, full-lot rear-yard addition on top of an existing one-story full-lot extension; as shown in existing conditions photographs and boards labeled LM-1 through LM-16, dated October 15, 2008, prepared by SawickiTarella Architecture + Design, shown as components of the application and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Upper East Side Historic District designation report states that 717-719 Madison Avenue are two neo-Grec style rowhouses built in 1877 and altered in 1923 with the construction of two-story commercial extension designed by Charles E. Birge; and that the buildings style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Upper East Side Historic District. With regard to the removal of the storefronts, the Commission found that a large percentage of the historic storefront remains intact, therefore the removal and replacement of the storefront will eliminate the significant historic fabric; that the proposed storefront infill will not match the historic storefront in terms of configuration and materials; and that the proposed work will diminish the special architectural and historic character of the building and the Upper East Side Historic District. Based on these findings, the Commission determined this portion of the work to be inappropriate the building and to the historic district and voted not to approve it. With regard to this proposal, the Commission found that the proposed addition will not be visible from any public thoroughfare; that the building already features a single story full lot extension, and the proposed addition on top of this extension will not increase the footprint of the building, and therefore will not eliminate the presence of a rear yard; and that other rear yard incursions exist within the block, this addition is already cut off from the main portion of the central donut by another full lot extension, therefore this addition will not diminish central greenspace. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on December 2, 2008, the Landmarks Preservation Commission received specifications, dated December 5, 2008, and final drawings labeled T-1.01, A-1.01, through A0.6, A1.0, A1.1, A3.0, A3.1, and A5.0 through A5.2, dated November 21, 2008, prepared by Joseph Tarella, R.A. Accordingly, staff reviewed the drawings and found that the proposal had been revised to include the restoration of the Madison Avenue storefronts. Staff reviewed these changes and finds that the design of the new storefronts is based on historic photographs; and that the restoration of the storefronts will not cause the removal of significant historic fabric that is evidence of the history and development of the building; and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-5545 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
