Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of June 10, 2008, following the Public Hearing and Public Meeting of
January 8, 2008, voted to approve a proposal to alter an existing penthouse as put forward in your application
completed December 13, 2007. The approval will expire June 10, 2014.


The work, as approved, consists of enclosing the open-air penthouse at the roof, by installing wood casement
windows behind the existing columns and construction of new stair bulkheads at the south, east and west portions
of the penthouse, which will be finished in a stucco at the east and west elevations to match the existing bulkhead,
and will feature a copper roof to match the existing; and installation of 8' high steel gates on Henry and Amity
Streets, at the entrances to the tenant walkway that will wrap around the rear of the building. The approved work
was shown on presentation boards consisting of existing condition photographs, a site map, renderings and
drawings labeled "Historical Condition," "Site Plan," "Henry Street Elevations, "Amity Street Elevations,"
"Views" (five boards with this title), "Roof Plan," and "Elevations" (two boards with this title), dated May 29,
2008, and prepared by RKT&B Architects, and presented at the Public Hearing and Public Meetings. As initially
proposed at the Public Hearing of January 8, 2008 and presented at the Public Meeting of June 10, 2008 the
application also included construction of new townhouses, but this portion of the application was removed from
the proposal, and was approved in revised form at a later Public Hearing under LPC 09-2568.

In reviewing this proposal, the Commission noted that the Cobble Hill Historic District designation report
describes 110 Amity Street as a Neo-French Renaissance style dormitory building, designed by William C.
Hough, and built in 1902; and that the buildings' style, scale, materials and details contribute to the special
architectural and historic character of the historic district.
With regard to this proposal, the Commission found that the proposal calls for enclosing the open-air penthouse,
and installing a series of wood casement windows to be set behind the columns, thus maintaining the
transparency of the existing penthouse; that the proposed stair bulkheads will be finished in stucco to match the
color of the existing stucco panels at the penthouse, and will have a simple copper roof to match the existing
copper cornice at the penthouse; that the proposed height of the new stair bulkheads will not exceed the height of
the existing penthouse; that the proposed stair bulkheads, visible from Henry Street between Amity Street and
Verandah Place, will be obscured by the presence of the proposed rowhouses at the Henry Street elevation; that
the work will not call undue attention to itself or detract from the special character of the building or the
streetscape; and that the proposed 8' metal gates bridging the gap between the proposed townhouses and the
existing historic building at the Amity street and Henry Street elevations will be of a simple design, and will not
call attention to themselves, or detract from the special character of the building or the streetscape. Based on these
findings, the Commission determined the proposed work to be appropriate to the building and the Cobble Hill
Historic District, and voted to approve the proposal.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.
Subsequently, on August 2, 2008, the Landmarks Preservation Commission received architectural drawings
labeled A-001, A-003, A-004, AR-101 through AR-105, A-100 through A-105, A-202, A-203, A-300, A-301,
A-401, A-500, A-501, A-502, A-600 through A-604, A-701 through A-703, M-101, M-101 through M-104,
M-106, M-201 through M-209, E-101through E-106, E-108 through E-113, P-101 through P-112, SP-101
through SP-107, FA-101, FA-102 (dated "Pricing Set" 7/3/08); S-1 through S-9, (dated "Pricing Set" 7/14/08);
A-704, (dated 9/14/07); on October 10, 2008, the Landmarks Preservation Commission received drawings
labeled A-201, A-204.1, through A-204.9, (dated 10/8/08); and on December 15, 2008, the Landmarks
Preservation Commission received drawings labeled M-105 and E-107 (dated "Pricing Set" 7/3/08); all prepared
by Peter Bafitis, R.A.

Accordingly, staff reviewed the drawings and found that the proposal has been modified to include complete
reconstruction as opposed to altering the existing open-air penthouse, with the approved modifications as stated
under the description of work above; and interior alterations, including demolition and construction of partitions,
installation of new plumbing, electrical and fire alarm systems, and installation of new finishes. With regard to
this additional work, the Commission found that the fabric of the existing open-air penthouse is deteriorated, the
exterior having been patched and coated numerous times; and that the rebuilt penthouse will have a stucco finish
and GFRC columns to match the color, texture, and detail of the existing stucco-covered penthouse; and that the
penthouse will have a copper roof to match the existing with respect to material and detail. The Commission also
found that the proposed change is keeping with the spirit of the original approval, and that the proposal approved
by the Commission has been maintained. Based on this and the above findings, the drawings have been marked
approved with a perforated seal, and Certificate of Appropriateness 09-4805 is being issued.

Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been
maintained. Based on this and the above findings, the drawings have been marked approved with a perforated
seal, and Certificate of Appropriateness 08-9432 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
