Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 23, 2008 following the Public Hearing of the same date, voted to approve certain proposed work at the subject premises, as put forward in your application completed on August 28, 2008. This approval will expire on September 23, 2014. The proposed work, as approved, consists of installation of a wood-and-steel pergola at the 12th floor terrace, located at the southeastern corner of the building; as shown in drawings labeled LM01, LM02, LM03, LM04, and LM05, prepared by Halsted Welles Associates, submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District designation report describes 299 West 12th Street as an apartment house built in 1929-31 and designed by Emery Roth; and that the building, in terms of style, scale, materials and details, contributes to the special architectural and historic character of the Greenwich Village Historic District. With regard to this proposal, the Commission found that the proposed work will not result in damage to or demolition of any significant architectural features of the building; that the pergola, proposed for installation at the south-east corner of the building, will not be seen in conjunction with the West 12th Street façade, but will be visible only over a secondary façade from a limited area on 8th Avenue to the east; that the existing parapet railing, which is also visible over the same secondary façade, will mitigate the presence of a new rooftop structure; that the proposed wood-and-metal pergola, with a slim profile and simple details, will not attract undue attention; and that the proposed work will not detract from the historic or architectural character of the building, the streetscape, or the Greenwich Village Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Historic District, and voted to approve this application. However, in voting to grant this approval, the Commission authorized the issuance of Certificate of Appropriateness 09-5696 (LPC 09-4393) under the condition that two (2) signed and sealed copies of the final Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on November 28, 2008, the Landmarks Preservation Commission received final drawings labeled CD-04.0, CD-04.1, and CD-04.2, dated November 14, 2008, prepared by Allan Klein, R.A. Staff reviewed the drawings and noted that the approved proposal has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 09-5696 (LPC 09-4393) is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
