Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 7, 2008 following the Public Hearing of the same date, voted to approve a proposal for a one-story rooftop addition at the subject premises, as put forward in your application completed September 11, 2008. This approval will expire October 7, 2014. The proposed work, as approved, consists of the construction of a non-visible one-story rooftop addition with metal cladding setback 1-foot from the rear façade and 59-feet, 2-inches from the Broome Street elevation, featuring a sloped standing seam roof rising to a height of 12-feet, 2-inches at the rear elevation and 8-feet, 1-inch at the front elevation; and installing a simple metal railing, 42-inches tall, setback 6-feet from the Broome Street elevation and at a small section on the eastern parapet approximately 26-feet from the rear façade; as shown in the presentation boards showing existing condition photographs, historic photographs, an area map, sightline studies, mock-up photos, a color rendering, existing and proposed roof plans, sections, and elevation drawings, all labeled LPC 01 through LPC 11, dated September 11, 2008, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. The proposal, as initially presented to the Commission, consisted of a minimally visible one-story rooftop addition visible from Crosby Street. In reviewing this proposal, the Commission noted that the SoHo - Cast Iron Historic District designation report describes 433 Broome Street as a building originally built in 1827, and converted to a French Renaissance style store and loft building in the 1870s; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the SoHo - Cast Iron Historic District. The Commission also notes that Warning Letter 04-0023 for, "replacement of the sidewalk in noncompliance with Certificate of No Effect 03-1916 (LPC 03-1101) issued the 17th of September 2002," was issued July 23, 2003. This permit is being issued in conjunction with Modification of Use and Bulk 09-5707 (LPC 09-3467), Permit for Minor Work 09-5768 (LPC 09-5473), Miscellaneous/Amendments 09-5708 (LPC 09-1108), Miscellaneous/Amendments 08-5294 (LPC 09-3462), Miscellaneous/Amendments 08-3910 (LPC 09-2750), and Certificate of Appropriateness 08-1893 (LPC 07-1893). With regard to this proposal, the Commission found that the roof contains no significant architectural features that will be lost or damaged by the construction of an addition; that the rooftop addition will not be visible from any public thoroughfare; that the scale of the addition will not overwhelm the significant architectural features of the building; that the design of the addition, featuring a shed roof, standing seam metal cladding on the side and rear elevations, and floor to ceiling glass on the front elevation will distinguish this as a later 21st century addition without distracting from the historic building; and that the proposed work will enhance the special architectural and historic character of the building and the SoHo-Cast Iron Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the SoHo - Cast Iron Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that the rooftop addition be made not visible from any public thoroughfare; and that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on November 10, 2008, the Landmarks Preservation Commission received a letter dated December 2, 2008, prepared by Mary B. Dierickx; an email dated December 2, 2008, prepared by Norman Cox, AIA; "433 Broome Street: Historic Conditions" dated issued September 2, 2008, prepared by Mary B. Dierickx; "433 Broome Street: Description of Work" dated issued September 22, 2008, prepared by Mary B. Dierickx; a statement labeled "Proposed Restoration Work - 433 Broome St"; final drawings labeled LPC 02, LPC 03, and LPC 04, dated issued September 11, 2008; and drawings labeled LPC 01, LPC 05, LPC 06, LPC 07, LPC 08, LPC 09, and LPC 10, dated revised October 15, 2008, prepared by Norman R. Cox, R.A. Accordingly, staff reviewed the drawings and found that the change requested by the Commission has been incorporated into the proposal and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 09-5706 (LPC 09-1105) is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
