Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 23, 2008, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the construction a new storefront at the ground floor, as put forward in your application completed September 17, 2008, and as you were informed in Status Update Letter 09-3962 (LPC 09-0791), issued September 23, 2008. This approval will expire September 23, 2014. The proposed work, as approved, consists of removing the a non-historic storefront at the ground floor and installing a new three bay storefront consisting of paired wood and glass doors flanked by a display window and residential entrance door framed in beige painted wood with paneled bulkheads and glass transoms; four paneled wooden pilasters painted off-white (Benjamin Moore OC-7, "Creamy White"); a wooden cornice painted off-white with brown painted metal pin mounted lettering ("Happy Science") with logo; and a wooden cornice at the roofline painted off-white; as shown in historic photographs, existing condition photographs, and drawings labeled 01, 02, 03, 04 and 05, dated September 15, 2008, prepared by Ely Valesquez, and presented during the Public Hearing. In reviewing this proposal, the Commission noted that the Tribeca East Historic District designation report describes 79 Franklin Street as a converted dwelling built in 1814-15 and altered in 1930 and 1966; and that in terms of its style, scale, materials, and details, it contributes to the special architectural and historic character for which the Tribeca East Historic District was designated. With regard to the proposal, the Commission found that the removal of the existing storefront infill will not result in the loss of significant historic fabric; that the configuration of the proposed storefront consisting of entrance doors and a display window featuring paneled bulkheads and transoms, is in keeping with historic storefronts found within the streetscape and historic district; that the width of the proposed residential entrance door is fixed in order to accommodate an existing standpipe that cannot be relocated; that the proposed cream painted wood pilasters and cornice will recall historic wooden storefronts in this historic district; and that the proposed painted metal pin mounted signage and logo will be located within the proposed cornice; will recall historic signage; and be appropriately scaled to not call undue attention to itself. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Tribeca East Historic District, and voted to approve this application. However, in voting to grant the approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Building filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on October 8, 2008, the Landmarks Preservation Commission received final drawings labeled T001, A601, A602, A603, and A604, dated September 30, 2008, prepared by Ely R. Velazquez, R.A. Staff reviewed the drawings and found that the work approved by the Commission has been maintained. The work also includes painting the existing stucco façade tan (Benjamin Moore C-26, "Monroe Bisque"), replacing six (6) one-over-one, double hung aluminum windows at the primary elevation finished in brown; and the replacement and relocation of an iron railing at the roof set back 4' from the façade. With regard to the additional proposed work, the Commission finds, in accordance with the provisions set forth in Title 63 of the Rules of the City of New York, Section 3-04 (c)(2) that the proposed replacement windows at the upper floors will match the historic windows in terms of configuration, operation, details, material and finish; that the brick façade currently is stuccoed over in a light tan color; and that the relocation of the metal railing at the roof will reduce the visibility from the public thoroughfare. Based on the above findings, the drawings are marked approved, and Certificate of Appropriateness 09-4453 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
