Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 16, 2007, following the Public Meeting and Public Hearing of August 14, 2007, voted to approve the proposed work at the subject premises, as put forward in your application completed July 19, 2007. This approval will expire October 16, 2013. The proposed work, as approved, consists of extending the wall set-back from the Fulton Street façade at the ninth floor, featuring a paired glass door and a one-over-one double-hung window; enlarging a window opening, and the installation of a one-over-one, double-hung wood windows within the enlarged opening at the ninth floor; enlarging the rooftop addition at the tenth floor with a one-story addition set back 13'9" from the Fulton Street elevation, featuring Cor-ten aluminum cladding, one-over-one, double-hung windows at the secondary elevation; a paired door and two one-over-one, double-hung windows at the Ann Street elevation; wood bi-part doors and windows at the Fulton Street elevation, installation of a railing at the terrace; installation of eighteen HVAC units, a railing and a bulkhead at the roof; removal of modern storefront infill on Fulton Street; the installation of new infill, featuring centered paired doors at the entrance, large panes of glass and bulkheads; the recreation of an existing cast iron column; and the re-construction of a balcony at the second floor; removal of modern infill from the first floor of the Ann Street façade and the installation of large panes of glass, bulkheads, the recreation of a cast iron column and two glass doors at the first floor; the removal of the windows at the second floor and the installation of single paned fixed wood window within the openings; and the removal of a non-decorative fire escape from the Ann Street façade. The proposal, as originally presented, consisted of the extension of the rooftop addition; the removal of a water tower and the construction of a new water tower; and combining the window openings at the second floor of the Ann Street facade; The proposal was shown in existing conditions photographs; color rendering of proposed storefront; and drawings labeled L100 through L120, dated July 3, 2007, prepared by Rebecca J. Rasmussen, R.A. submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission notes that the designation report describes 127 Fulton Street as a Renaissance Revival style office building designed by De Lemos & Cordes and built in 1892-3. With regard to this proposal, the Commission finds that the proposed extension to the existing rooftop addition will not increase the overall height of the building; that the building currently features two set backs, and therefore, the extension will be in keeping with the buildings stepped massing; that the use of a dark metal cladding at the proposed rooftop addition, and the placement of windows at the lot line relate well to the existing building; that the configuration, details and materials of the proposed storefront at the to Fulton Street façade are restorative in nature and are based on historic photographs; that the storefront infill proposed for Ann Street fits neatly within the historic piers and lintels, and that the configuration, materials, finish and details of this storefront infill relate well to the building; and that the proposed removal of the fire escape from the Ann Street facade will not result in the loss of significant historic fabric, and that its removal will better reveal the historic façade and allow for its restoration. Based on these findings, the Commission determined the proposed work to be appropriate, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that a set of unmounted copies of the presentation drawings and two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on January 22, 2008, the Landmarks Preservation Commission received final drawings labeled L100 through L120, dated revised December 16, 2007, prepared by Rebecca J. Rasmussen, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 08-6556 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
