Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of November 20, 2007, following the Public Hearing of July 24, 2007, the
Landmarks Preservation Commission voted to grant a Certificate of Appropriateness for the proposed work at the
subject premises, as put forth in your application completed on June 28, 2007. This permit will expire on
November 20, 2013.

The proposed work, as approved, consists of removing the ground floor and second floor modern metal and glass
infill and signage; and recreating the building's circa 1908 base and storefronts; including reproducing the two
missing double height fluted columns in a glass fiber reinforced concrete (GFRC); installing painted aluminum
framing system comprised of glass display windows at the second floor, center bay frameless vitrines flanked by
barrel arched aluminum canopied entrances at the two end bays also with transom lights. Work at the parapet of
the building (front façade and side returns), includes removing the original terra cotta parapet, including the
balustrade, and a number of courses of the water table, to a point just above the wide cornice band with circular
details and dentilated coursing; and reconstructing the parapet with fiberglass reinforced polymer (FRP) units to
match the original terra cotta blocks. The proposal as initially presented to the Commission included recreating
the building's base and storefronts from 1926. All proposed work included historic photographs, current condition
photographs labeled 1 through 5, and drawings, labeled A-1 through A-8, dated February 7, 2007; June 24, 2007,
and revised presentation boards A-7, A-7a, A-7b, A-7c, A-7d, dated February 7, 2007; last revised November 20,
2007, prepared by Gary H. Silver Architects, P.C., submitted as components of the application, and presented at
the Public Hearing and Public Meeting.

In reviewing the proposal, the Commission noted that the Madison Square North Historic District designation
report describes 1182 Broadway as a Beaux Arts style store and office building designed by William L. Rouse
and built in 1908-1910; and that the style, scale, age, materials, and details of the building contribute to the
special architectural and historic character of the Madison Square North Historic District. The Commission
finally noted that Certificate of No Effect 07-9758 was issued January 10, 2008 for restorative work, and that
Modification of Use 08-15133 was issued January 18, 2008 approving a request that the Landmarks Preservation
Commission issue a report to City Planning Commission relating to an Authorization for use pursuant to section
74-711 of the Zoning Resolution.

With regard to this proposal, the Commission found that the severely deteriorated condition of the terra cotta
cornice, balustrade, and underlying structural steel, based on an engineers report and physical documentation,
warrants its replacement; that the proposed fiberglass reinforced polymer parapet and cornice will match the
original terra cotta units in terms of dimensions, texture, finish and detail of the historic fabric, and its location at
the top of this tall building will render the change in material imperceptible; that the removal of the modern
storefront infill, exterior signage and metal cladding will eliminate modern alterations which detract from the
special historic and architectural character of the building; that the removal of the fragments of the 1920's
storefront will allow for the restoration of the original columns which will enhance this facade; that the
reconstruction of the two center columns, second floor show windows and ground floor vestibule and display
window will match the design and proportions of the historic storefront entry, originally built in 1908; that the
configuration of the storefront infill, in terms of the number of doors and the wide pilasters, result in proportions
that will relate harmoniously to the historic show windows at the second floor; that the details and material of the
proposed aluminum storefront infill, featuring paired doors with glass transoms, and having a painted finish will
recall the transparency, scale, and visual texture of historic storefronts as seen in historic photographs of the
building; and that the proposed signage, will be well scaled to the facade, and will be in keeping with the
commercial character of the historic district. Based on these findings, the Commission determined that the work is
appropriate to the building and to the historic district.

However, in voting to grant this approval, the Landmarks Preservation Commission made its determination
subject to the condition that two sets of final signed and sealed drawings showing the approved proposal, which
shall be filed with the Department of Buildings, be submitted to the Landmarks Preservation Commission for
review and approval.

Subsequently, on January 4, 2008, the staff of the Commission received drawings A-1 through A01- through
A-08, dated February 7, 2007; last revised November 20, 2007, prepared by Gary H. Silver, R.A and drawing
1515-1 preliminary fiberglass drawing prepared by Architectural Fiberglass Corp., dated November 18, 2007.
The Landmarks Preservation Commission staff reviewed the drawings and found that the proposal approved by
the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission
with a perforated seal, and this Certificate of Appropriateness is being issued.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of Tuckahoe
marble, Terra Cotta, and brick and mortar samples, and all other masonry samples, finish paint colors and finish
colors, GFRC and FRP samples for color, texture, details and finish, as well as requiring shop drawings for
storefront infill, columns, windows, doors, cornices, and other architectural details as required, cleaning samples
on existing all prior to the commencement of the work. Please contact the Landmarks Preservation Commission
staff to arrange a site visit.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
