| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 22, 2007, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on April 26, 2007. This permit will expire on May 22, 2013. The work, as approved, consists of removing a portion of the brick masonry below the sill at the western most window at the second floor on the front façade and the arch-head, wood and glass one-over-one double-hung window; and installing a arch-head, wood and glass door with a horizontal muntin, featuring a off white painted finish. All proposed work was shown in photo boards and drawings labeled LM-1, LM1.1, LM-2 and LM-3, dated February 21, 2007, prepared by Howard Spivak, submitted as components of the application and presented at the Public Hearing and Public Meeting. In reviewing the proposal, the Commission noted that the Upper West Side/ Central Park West Historic District designation report describes 31 West 82nd Street as a Romanesque Revival style rowhouse with Northern Renaissance style elements designed by Edward Chester Smith built in 1886-87; and that the building's style, scale and materials are among the features that cause it to contribute to the special architectural and historic character of the Upper West Side/ Central Park West Historic District. With regard to this application, the Commission found that removing the existing window and related area of plain masonry will not cause the destruction of any significant architectural features of the building; that the portion of the opening to be altered to accommodate the door will be concealed from view by the balustrade above the building's base; that the proposed door will match the configuration, details and finish of the historic window and will relate harmoniously with the windows on the facade; that the details of the new door featuring a horizontal "muntin" bar and interior hinge hardware, will help this door to read as a window when viewed from the street; and that the proposed work will not diminish the special architectural or historic character of the building or the Upper West Side/Central Park West Historic District. Based on these findings, the Commission determined that the work is appropriate to the building and to the historic district, and voted to approve this application. Subsequently, on September 5, 2007, the Commission received two sets of final stamped and signed drawings labeled A-1 through A-5, dated August 30, 2007, prepared by Howard B. Spivak, R.A. The Landmark Preservation Commission staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
