| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of July 17, 2007, following the Public Meeting of June 26, 2007, and the Public Hearing of June 19, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on May 24, 2007, and as you were informed in Status Update Letter 08-0842 (LPC 07-5972), issued July 17, 2007. The proposed work, as approved, includes constructing a three-story plus basement, brick-clad rear addition; and enlarging and reducing the existing rear façade window openings, and installing six-over-six, double-hung windows and multi-pane French doors, as shown in drawings and photographs, labeled BD02-a, BD02-b, BD02-c, BD05, and BD06b, dated June 29, 2007, and BD08-a, LC01-c, and LC05, dated May 22, 2007, prepared by Garo Gumusyan, Architect, submitted as components of the application and presented at the Public Hearing and Public Meetings. The proposal as initially presented to the Commission was for a five-story plus basement rear addition clad in stucco, as shown in drawings BD02-a, BD02-b, BD02-c, Bd05, BD06-b, and LC01-b, dated May 22, 2007, prepared by Garo Gumusyan, Architect. In reviewing this proposal, the Commission noted that the designation report states that 14 East 95th Street is a Renaissance Revival style rowhouse designed by Henry Andersen and built in 1899; and that the building's style, scale, materials and details are among the features which contribute to the special historic and architectural character of the Carnegie Hill Historic District. The Commission further notes that the building has an original three-story plus basement rear ell. With regard to this proposal, the Commission found that the rear addition will not be visible from a public thoroughfare; that the proposed rear addition will be set back from the existing historic ell, and thereby preserve the existing historic pattern of ells within this row of houses; that the proposed addition will not project further than other existing rear additions within the block, and thus will not diminish the central green space; that the proposed addition will not rise the full height of the building, thereby preserving the historic plane of the upper floors of the historic row; that altering the size and proportions of the existing window openings on the rear façade will not alter the existing fenestration pattern which is consistent across the row; and that the proposed work will not diminish the special historic and architectural character of the building or the row. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. In voting to grant this approved, the Commission made its determination subject to the condition that two sets of the final signed and sealed Department of Buildings filing drawings be submitted to the staff of the Commission for review and approval. Subsequently, the staff of the Commission received drawings BD01, BD03-a, BD06-a, and BD06-b, dated May 22, 2007, and BD02-a, BD02-b, BD03-b, and BD05, dated June 26, 2007, prepared by Garo Gumusyan, Architect. The Commission reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved by the LPC with a perforated seal and Certificate of Appropriateness 08-2857 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
