Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of May 15, 2007, following the Public Hearing and Public Meeting of March
6, 2007, the Landmarks Preservation Commission voted to grant a Certificate of Appropriateness for the proposed
work at the subject premises, as put forth in your application completed on February 8, 2007. This permit will
expire on May 15, 2013.

The proposed work, as approved, consists of constructing a one story rooftop addition and mechanical equipment
on roof of the Broadway building; constructing a one story rooftop addition and mechanical equipment on the
roof of the Mercer Street building; installing new wood ground floor infill on both the Broadway and Mercer
Street facades; removing the fire balcony on the Broadway façade; and constructing a new stoop and landing on
the Mercer Street facade. The proposal as initially presented to the Commission included a two story roof top
addition, sign bands and multiple signs at each ground floor entrance; exterior lighting at both facades; the
removal of iron shutters; the removal of fire escape on the Mercer Street façade; and enclosing the under-stoop of
the proposed stoop at Mercer Street. All proposed work included historic photographs, current condition
photographs and drawings, were mounted on presentation boards labeled A-2a, A-2b, A-2c, A-4 through A-14,
dated January 26, 2007, and revised presentation boards labeled A-3b, A-4, A-5,A-6,A-8, A-9, dated April 20,
2007 and A-12, A-14 and A-15, dated March 22, 2007, prepared by BAI Group, Inc., submitted as components of
the application, and presented at the Public Hearing and Public Meeting.

In reviewing the proposal, the Commission noted that the SoHo Cast Iron Historic District designation report
describes 577 Broadway, also known as 148 Mercer Street, as a store building built in 1860; and that the style,
scale, age, materials, and details of the building contribute to the special architectural and historic character of the
SoHo Cast Iron Historic District. The Commission finally noted that Certificate of No Effect 08-1728 was issued
August 1, 2007 for restorative work, and that Modification of Use 08-1730 was issued August 14, 2007
approving a request that the Landmarks Preservation Commission issue a report to City Planning Commission
relating to an Authorization for use pursuant to section 74-711 of the Zoning Resolution.

With regard to this proposal, the Commission found that the removal of the existing modern storefront infill on
Broadway will eliminate features which detract from the building and the surrounding streetscape; that the design
of the proposed wood and glass storefront infill on Broadway is based on photographic documentation and
physical evidence, and is in keeping with the style, material and details of the building; that the proposed signage,
featuring pin-mounted metal letters with a concealed exterior light source mounted above the storefront, set
within a wire mesh frame, will not obscure any architectural details, and is a type of sign on storefronts on
Broadway within this historic district; that the installation of the fire balcony on Broadway has compromised and
damaged the Tuckahoe Marble façade and obscures the façade, and therefore its removal will allow for the repairs
of the façade and restoration of significant marble details; that the courtyard facing façade to be removed had
previously been compromised by later alterations; that the historic metal fire shutters will be restored and re-used
in place, or relocated and incorporated elsewhere on the new courtyard infill; that the proposed one-story rooftop
addition and infill at the interior court, in terms of its simple design and massing, will be harmonious with the
typology of this historic store and loft building; that only the rooftop mechanical bulkhead will be visible from
any public thoroughfare and that the proposed rooftop bulkhead will only be visible from one block north and
south, in the context of other secondary facades and rooftop mechanical equipment; that the material, fenestration
and details will be in keeping with the character of secondary façade elements; that the installation of the stoop,
featuring metal stair and railing on the Mercer Street facade is in keeping with the types of stoops found on
certain commercial buildings within the SoHo-Cast Iron Historic District; that the placement of this stoop and
new storefront infill will preserve the historic iron shutters located at the ground floor in a fixed open position;
that the new wood and glass infill on the Mercer Street façade featuring glass display windows and transoms, and
metal grill bulkheads is consistent with the treatment typically found on the Mercer Street facades of buildings in
this historic district; and that although the operation of the second floor windows on the Mercer Street façade will
be fixed, the construction and details of the windows will reflect the original operation of the historic
double-hung windows. Based on these findings, the Commission determined that the work is appropriate to the
building and to the historic district.

However, in voting to grant this approval, the Landmarks Preservation Commission made its determination
subject to the condition that the constructed mock-up on the Broadway roof accurately reflect the height of the
approved lowered mechanical equipment, and that two sets of final signed and sealed drawings showing the
approved proposal, which shall be filed with the Department of Buildings, be submitted to the Landmarks
Preservation Commission for review and approval.

Subsequently, on August 1, 2007, the staff of the Commission received drawings A-1, A-2a, A2b, A-2c, A3a, 4a,
A-4b, A-7, A-10, A-11, A-12, A-13, A-15 and A-16 dated March 20, 2007/ March 22, 2007, drawing A3b, A-5,
A-6, A-8, A-9 and A-14 dated April 20, 2007, prepared by Atilla Bagcilar, R.A. The Landmarks Preservation
Commission staff reviewed the drawings and found that the proposal approved by the Commission has been
maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and
this Certificate of Appropriateness is being issued.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of Tuckahoe
marble, cast stone, brownstone, brick and mortar samples, and all other masonry samples, finish paint colors and
finish colors, as well as requiring shop drawings for all windows, doors, cornices, cast iron vault lights and other
architectural details, all prior to the commencement of the work. Please contact the Landmarks Preservation
Commission staff to arrange a site visit.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
