Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 24, 2007, following the Public Hearing of April 24, 2007, voted to
deny a proposal to legalize removal of historic stone sidewalk pavers, and voted to approve the installation of a
new storefront, as put forth in your application completed on April 4, 2007.

The work denied consists of the removal of historic stone pavers which comprised a portion of the sidewalk, and
the modern concrete infill, and the installation of a new sidewalk fabricated entirely of tinted concete, in
non-compliance with Certificate of No Effect 03-1916. The work approved consists of the removal of the modern
storefront infill; the installation of a painted wood storefront, with paired paneled wood and glass doors and a
display window set above a paneled wood bulkhead, and divided light transoms with rounded upper corners; and
the installation of light fixtures secured to the wooden storefront framing; and signage painted on the glass and
also on the signband. The proposal also includes the replacement of missing cast iron elements; and scraping,
priming, and painting the cast iron elements, and the upper floors. All of the work was shown in historic
photographs, photographs of the existing conditions, drawings titled "Proposed Storefront", "Typical Storefront
Details, and "Sidewalk Diagram", a block plan, a catalog cut of the proposed light fixture, Bega 2294P; and paint
samples, Benjamin Moore Whale Gray 2134-40 for the storefront and trim, and Benjamin Moore Heather Gray
2139-40 for the upper floors, all prepared by Franke Gottsegen Cox Architects and presented at the Public
Hearing and the Public Meeting.

In reviewing this proposal, the Commission noted that the SoHo-Cast Iron Historic District Designation Report
describes 433 Broome Street as a building originally built in 1827, and converted to a French Renaissance style
store and loft building in the 1870s; and that the style, scale, materials, and details of the building are among the
features that contribute to the special architectural and historic character of the SoHo-Cast Iron Historic District.
The Commission also noted that Landmarks Preservation Commission Certificate of No Effect 03-1916 was
issued on September 17, 2002, for the removal of the historic stone pavers and modern concrete infill, the
reconstruction of the sidewalk vault, and the reinstallation of the pavers

With regard to the proposed legalization of the removal of the stone pavers, the Commission found that that the
removal of the bluestone eliminated a significant feature of the streetscape which was evidence of the evolution
of this historic district; and that their removal has diminished the building, the streetscape, and the SoHo-Cast
iron Historic District.
Based on these findings, the Commission determined this portion of the proposed work to be inappropriate to the
building, and voted to deny this portion of the application.

With regard to the installation of the new storefront, the Commission found that the removal of the existing
storefront infill will not require the destruction of any significant historic fabric;
that the removal of the modern cladding above the modern doors and the display window will allow the
restoration of the historic ground floor openings, and will re-establish the relationship between the height of the
storefront openings and the historic window openings on the upper floors; that replacing the missing elements of
the column capitals will bring the historic cast iron columns closer to their historic appearance; that the
configuration, materials, finish, and details of the new painted wood storefront infill are in keeping with the
historic storefronts found on buildings of this age and style in this and adjacent historic districts; that the new
storefronts will restore the ground floor transparency which is a feature of historic storefronts at buildings of this
age and type; and that for these reasons the proposed storefront changes are in keeping with the special
architectural and historic character of the building and the SoHo-Cast Iron Historic District.. Based on these
findings, the Commission determined this portion of the proposed work to be appropriate to the building, and
voted to approve it.

On August 13, 2007, the Commission received drawings A101 and A501, dated August 13, 2007, showing the
approved storefront design, and also the re-installation of stone sidewalk pavers, prepared and submitted by
Franke Gottsegen Cox Architects. Staff has reviewed these drawings and finds that the storefront proposal
approved by the Commission has been maintained; and that the installation of the sidewalk pavers is in
compliance with Certificate of No Effect 03-1916. Based on this and the above findings, Certificate of
Appropriateness 08-1893 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
