Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of July 17, 2007, following the Public Meeting of June 26, and the Public
Hearing of June 19, voted to grant a Certificate of Appropriateness for work at the subject premises, as put
forward in your application complete on May 24, 2007; and as you were informed in Status Update Letter
08-0828 (LPC 07-2575) issued on July 17, 2007.

The proposal, as approved, includes the raising the brick parapets at the secondary west and north elevations; and
constructing a rooftop addition with a rooftop railing. The proposal was shown on presentation boards LPC 1,
LPC 2.1, LPC 2.2, LPC 3, LPC 4, LPC 5, LPC 6, and LPC 7, dated June 6, 2007, prepared by Joseph J.
Kleinmann Architect; and all presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that 250 Mercer Street, aka 683-685 Broadway, is a Georgian
Revival style store and loft building designed by W. Wheeler Smith and built in 1899-1901; and that the
building's style, scale, materials and details are among the features that contribute to the special architectural and
historic character of the NoHo Historic District.

With regard to this proposal, the Commission found that raising the parapet to obscure visibility of the rooftop
addition from the west will not alter or destroy significant architectural features of the secondary west elevation;
that the proposed penthouse will not be visible over the primary façade and therefore will not detract from the
composition of the building's primary façade or its relationship to the streetscape; that the proposed penthouse
will be visible over the secondary façade only from a great distance and will be obscured by the extended parapet,
which will blend with the rear wall; that the proposed penthouse will be most visible over the undeveloped
secondary facade in conjunction with other utilitarian rooftop features; that the proposed rectangular shape of the
proposed addition will present a silhouette which is typical of rooftop bulkheads traditionally found on tall
buildings within the district, and will be harmonious with the streetscape, given its heterogeneous and diverse
scale; and that the additional bulk at the rooftop will not detract from the surrounding area given the scale of the
loft building in relation to its urban landscape. Based on these findings the Commission determined the work to
be appropriate to the building and the NoHo Historic District, and voted to approve it.

However, the Commission made its determination subject to the stipulation that two sets of Department of
Buildings filing drawings be submitted to the Commission for review and approval. Subsequently, on July 30,
2007, the Commission reviewed drawings LPC 1, LPC 3, LPC 4, LPC 5, LPC 6, and LPC 7, dated received July
30, 2007, by staff, and prepared by Joseph J. Kleinmann, R.A. The Commission reviewed the drawings and
found that the work approved by the Commission has been maintained. Based on this and the above findings, the
drawings are being marked approved with a perforated seal, and Certificate of Appropriateness 08-1750 is being
issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
