Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of June 5, 2007, following the Public Hearing of the same date, voted to approve certain work at the subject premises, as put forward in your application completed on May 10, 2007. This approval will expire on June 5, 2013. The proposed work, as approved, consists of lowering 12 window sills at the second floor along the Thomas Street facade to align with the existing window sills on the Hudson Street facade, and the installation of 6 eight-over-eight, 2 six-over-six and 4 four-over-four wood windows in these enlarged openings, as shown in drawings and presentation boards labeled 1, 2, 3, 4 and 5, dated July 12, 2007, prepared by Jacobson Shinoda Architects, submitted as components of the application and presented at the Public Hearing and Public Meeting. In reviewing this application, the Commission noted that the Tribeca West Historic District designation report describes 46-50 Hudson Street as a early 20th century Commercial style building designed by William F. Hemstreet and built in 1925; and that in terms of its style, scale, materials, and details, the building contributes to the special architectural and historic character of the Tribeca West Historic District. With regards to this proposal, the Commission found that lowering the window sills along Thomas Street to match the window sill level along Hudson Street will not involve the removal of significant historic fabric; that the new windows proposed for the Thomas Street facade will match the size, shape, operation, configuration, materials, details and finish of those on Hudson Street and will thus maintain a consistent fenestration throughout the building; and that the work will not diminish the special architectural or historic character of the building or the streetscape. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Tribeca West Historic District and voted to approve it. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two signed and sealed sets of the Department of Buildings drawings for the approved work. Subsequently, on June 25, 2007, the Landmarks Preservation Commission received final drawings labeled A-201, A-501, A-741, D-102, dated June 5, 2007, all prepared by Steven L. Jacobson R.A. The Commission reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal and Certificate of Appropriateness 08-0459 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
