| Text | ISSUED TO: Kung Shum Ya Zhou Wen Hua Enterprises, Inc. 15 East 40th Street New York, NY 10016 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 17, 2007, following the Public Hearing and Public Meeting of February 27, 2007, voted to grant a Certificate of Appropriateness approving the installation of new store front infill and denying the installation of a marquee at the subject premises, as put forth in your application completed on February 1, 2007. This permit will expire on April 17, 2013. The work, as approved, consists of removing the existing non-historic storefront and installing new aluminum storefront infill with metal louvers at the upper transom in the two southmost bays and over the new infill at the north most bay. The work denied includes installing a metal and glass marquee in the cast iron spandrel above the storefront columns with tie backs affixed to the stone facade at the second floor. This work was shown in photo boards; material samples; drawings 1 through 16, dated received April 17, 2007, and drawings from the February 27, 2007, presentation; prepared by workshop/apd, LLC, and submitted as components of the application, and presented at the Public Hearing and Public Meetings. In reviewing this application, the Commission noted that the Tribeca East Historic District designation Report described 58 White Street as a Second Empire style store and loft building built in 1866-68; and that the building's style, scale, materials, and details are among those features that contribute to the special architectural and historic character of the Tribeca East Historic District. The Commission also noted that Certificate of No Effect 99-6396 (LPC 99-5560) was issued May 26, 1999, for "replacing the sidewalk vault and new sidewalks." With regard to the proposed storefront infill, the Commission found that the proposed work will not involve the removal of original or significant building fabric; that the proposed storefront infill will retain the historic cast iron piers, and the new infill will fit within the openings framed by these piers; that the configuration and proportions of the storefronts in the two western most bays are in keeping with the historic storefronts found within the historic district; and those storefront bays will maintain transparency at the ground floor which is an important feature found historically on buildings within this historic district; that the proposed infill at the eastern bay will be a contemporary evocation of the solid metal shutters and roll-down grilles historically found at elevator bays in buildings of this age, style and type; and that the proposed metal screens will recall the historic roll-up fire shutters seen on other cast iron store and loft buildings of this age. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Upper West Side/Central Park West Historic District, and voted to approve it. With regard to the marquee, the Commission found that the marquee would be installed through the historic cast iron fascia and may have caused damage to significant historic fabric; and that while marquees are found on buildings in other historic districts such as Tribeca West, there is little precedent within the Tribeca East Historic District which has a distinct and special character within the larger Tribeca area defined by its many block fronts of ornate store and loft buildings which effected the district's role as the center for dry goods and related businesses. Based on these findings, the Commission determined the work to be inappropriate to the building and to the historic district and voted not to approve it. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that the applicant submit two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and approval. Subsequently, on May 16, 2007, the staff of the Commission received drawings G001, A100, A200, and A400, dated May 3, 2007; prepared by Michael Zenreich, R.A. The Commission staff noted that the drawings included additional work including, interior alterations, including the demolition and construction of interior non-bearing partitions and finishes at the first floor, including upgrading the plumbing, electrical, and mechanical systems. The Commission reviewed the submitted drawings and found that proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
