Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of July 17, 2007, following the Public Meeting and Public Hearing of
December 2, 1997, voted to approve the installation of a brick garden wall at the edge of the front property line
with modifications installed without Landmarks Preservation Commission permit at the subject premises, and as
put forward in your application completed on October 30, 1997.

The work approved consists of legalizing and modifying a low brick garden wall topped with an iron railing by
removing the railing, lowering the corner posts and the wall to five courses of brick, and replacing the top row of
bricks, removing the iron gate at the front walk. The work was shown in existing conditions photographs, dated
June 26, 2007, provided by Daniel Karatzas, and presented at the Public Hearing and Public Meeting. The
proposal as originally presented to the Commission called for the legalization of the wall and gates as is.

In reviewing this proposal, the Commission noted that the Jackson Heights Historic District designation report
describes 35-52 88th Street as one of a group of Anglo-American Garden style attached and semi-detached house
built in 1925-1926, designed by Robert Tappan; and that the building's style, scale, design, details, and materials
are among the features which cause this building to contribute to the special architectural and historic character of
the Jackson Heights Historic District. The Commission also noted that Violation 98-0062 was issued August 12,
1997 for "Installation of brick wall and metal gate at front yard without permit".

With regard to the legalization and modification of the brick garden wall, the Commission found that the
installation of a low wall will not interrupt the original visual uniformity of the lawns sloping down to the
sidewalk that is characteristic of the Jackson Heights Historic District; that the installation of a low brick wall at
the garden is in keeping with the suburban character of these houses in this historic district and will not draw
attention from the houses; that the size, color and type of brick will closely match the brick of the building; that
the brick material and height of the garden wall is similar to other existing low garden walls on this street; and
that the presence of the garden wall will not diminish the special architectural and historic character of the
building or the Jackson Heights Historic District. Based on these findings, the Commission determined the brick
wall with modifications to be appropriate to the building and the historic district, and therefore voted to approve
it.

Prior to making any modifications to the brick wall, please schedule a meeting with staff to discuss the design of
the wall, and review of the brick samples. Please note that the brick wall must be modified by October 17, 2007.
Violation 98-0062 remains in force against the property until the work has been completed and inspected for
compliance. When the work is complete, please make a written request for a Notice of Compliance and include
photographs of the completed work.

Please note that this permit contains a compliance date of October 17, 2007. If you do not complete the work by
this date, A Notice of Violation (NOV) originating from the Environmental Control Board may be issued in
accordance with Title 63 of the Rules of the City of New York, Section 7-02(c).

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
