| Text | ISSUED TO: Peter Moore 46 White Street LLC 515 Canal Street, 1C New York, NY 10013 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 17, 2007, following the Public Hearing and Public Meeting of February 27, 2007, voted to approve certain work at the subject premises as put forward in your application completed on February 1, 2007. The proposal, as approved, consists removing existing diamond plate steps, and installing new painted wood and glass storefront infill with paneled bulkheads; at the basement and ground floor rear addition, removing the existing skylight, raising the parapet wall, and constructing a new skylight, enlarging and modifying masonry window openings and installing new single-pane sash and open railings; demolishing the existing roof; constructing a two-level rooftop penthouse, the lower level of which will incorporate a sky-lit well and will be set partially below the level of the original roof, and clad in standing seam zinc and wood slats, as shown in documents entitled "46 White Street / New York, NY 10013" dated Mar. 15, 2007, prepared by Ben Hansen Architect, submitted as components of the application and presented at the Public Hearing and Public Meetings. The proposal as originally presented called for an open light well at the rooftop addition, and did not include display window bulkheads, as shown in documents entitled "46 White Street / New York, NY 10013" dated Jan. 15, 2007, prepared by Ben Hansen Architect. In reviewing this proposal, the Commission notes that the Wood's Mercantile Buildings-Individual Landmark, is a Second Empire style store and loft building built in 1865-67, located within the Tribeca East Historic District; and that the style, scale, materials and details of the building are among the features that also contribute to the special architectural and historic character of the Tribeca East Historic District. The Commission further noted that Certificate of No Effect 05-3574 (LPC 05-2023) was issued November 16, 2004 approving the construction of a non-visible rooftop additional and minimally visible bulkhead at 48-50 White Street, a/k/a the Wood's Mercantile Buildings-Individual Landmark. With regard to this application, the Commission found -that the design of the new storefront infill will retain historic material and recall the historic infill found at the adjacent building, and therefore, will further unify the two buildings as a whole; that the removal of the existing infill and the replacement or elimination of the diamond plate steps will not eliminate historic material; that the display windows will be consistent with the size and scale of windows found on this building's twin and in other and other store buildings in this historic district; that the proposed paint color for the storefront infill will harmonize with the masonry above; that the existing windows and skylights are deteriorated and warrant replacement; that the existing rear extension is built close to the rear lot line and is surrounded by walls and other buildings built close to the lot lines, therefore, the proposed work on the rear extension will not be visible from a public thoroughfare and barely perceptible from the center of the block; that the retaining the metal shutters will help preserve significant historic material; that the roof of the building has no significant architectural features which would be lost or damaged as result of the construction of the proposed addition; that the rooftop addition will be minimally visible from a limited vantage point on West Broadway and Sixth Avenue and, therefore, will not detract from the primary facades of the buildings; that the addition is only minimally visible in conjunction with the primary facades of the adjacent buildings, at an oblique angle and in conjunction with other higher rooftop features, and therefore, will not diminish the special character of the primary facade; that because the rooftop addition will be set into the roof, its overall height will not overwhelm or detract from this building; and that the proposed work will not diminish the special architectural and historic character of the building or the historic district. Based on these findings, the Commission determined the proposed work to be appropriate to the Individual Landmark and to the Tribeca East Historic district and voted to approve it. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that two sets of final signed and sealed drawings be submitted to the Landmarks Preservation Commission for review and approval. Subsequently, the Commission received drawings A0.2, A0.2, A0.3, D1.0 through D1.3, A1.0 through A1.5, A2.0 through A2.6 dated 5/14/07, prepared by Ben Hansen Architect. Accordingly, the staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved by the Landmarks Preservation Commission with a perforated seal and Certificate of Appropriateness 08-0059 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
