Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of May 22, 2007, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness to legalize work completed without permits at the at the subject premises,
with modifications, as put forward in your application completed on April 26, 2007.

The proposal, as approved, includes legalizing the installation of grilles at the parlor floor windows; the alteration
of the existing areaway fence by making a portion of it operable; and modifying the wood access ramp at the
areaway by painting it dark brown, and removing the round newel heads. The proposal was shown on
presentation boards consisting of a historic district map, and historic and current condition photographs, prepared
by Ariane Randall; all presented at the Public Hearing and Public Meeting. The proposal, as originally
presented, did not call for modifying the wood areaway ramp.

In reviewing this proposal, the Commission noted that 429 East 139th Street is a neo-Grec style rowhouse
designed by William O'Gorman and built in 1892; and that the building's style, scale, materials, and details are
among the features which cause this building to contribute to the special architectural and historic character of the
Mott Have East Historic District. The Commission further noted that Warning Letter 07-0472 was issued on May
3, 2007, for "Installation of wood access ramp at areaway without permit(s);" Warning Letter 07-0473 was issued
on May 3, 2007, for "Installation of mailbox with metal awning at areaway without permit(s);" Warning Letter
07-0474 was issued on May 3, 2007, for "Installation of security door and parlor floor window grilles without
permit(s);" and Warning Letter 07-0475 was issued on May 3, 2007, for "Alterations to gate and areaway railings
without permit(s)."

With regard to this proposal, the Commission found that window bars are typical later alterations on buildings of
this age and type; that the bars fit the glazed opening, which was altered prior to designation; that that the new
gate at the areaway remains identical in appearance to the section of railing that was installed prior to designation;
that the wood ramp is not anchored into the areaway paving, and is free-standing, and therefore its installation is
easily reversible; that the existing paving at the areaway is not historic, and therefore the installation of the ramp
does not obscure significant protected features; that the removal of the round newel heads at the tops of the posts,
and painting the wood, will diminish the degree to which the ramp calls attention to itself by blending in with the
painted finishes on the building. Based on these findings, Certificate of Appropriateness 08-0603 is being issued.

PLEASE NOTE: This permit is issued contingent upon the Commission's review and approval of the paint color
for the ramp prior to the commencement of the work.

Warning Letter 07-0475, issued on May 3, 2007, for "Alterations to gate and areaway railings without permit(s)",
is hereby rescinded with the issuance of this permit.

Please note that Warning Letter 07-0472, issued on May 3, 2007, for "Installation of wood access ramp at
areaway without permit(s);" will remain in effect until the work approved under this permit has been completed
in compliance with this permit, and photographs of the completed work are submitted to the Landmarks
Preservation Commission along with a written request for a Notice of Compliance.

THIS PERMIT CONTAINS A COMPLIANCE DATE OF July 10, 2008. If you do not complete the work by
this date, a second Notice of Violation (NOV) originating from the Environmental Control Board may be issued
in accordance with Title 63 of the Rules of the City of New York, Section 7-02 (c). This NOV would require a
court appearance and a civil fine may be imposed. Once the corrective work is completed, promptly submit a
written request for a Notice of Compliance, along with photographs documenting the finished work, to the
Commission.

Warning Letter 07-0473, issued on May 3, 2007, for "Installation of mailbox with metal awning at areaway
without permit(s); and Warning Letter 07-0474, issued on May 3, 2007, for "Installation of security door and
parlor floor window grilles without permit(s);" remain in effect against the property.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
