Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 22, 2007, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for work at the subject premises, as put forward in your application complete on April 26, 2007; and as you were informed in Status Update Letter 07-8659 (LPC 07-6423) issued on May 22, 2007. The proposal, as approved, includes the installation of one new window opening at the developed secondary south elevation, featuring a black-painted six-over-one double hung wood window. The proposal was shown on presentation boards A-101, A-102 and A-103, dated revised May 22, 2007, prepared by David Kleinberg Design Associates; all presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that 1133 Fifth Avenue is a neo-Federal style apartment building designed by Emery Roth and built in 1927-28; and that the building's style, scale, materials, and details are among the features that contribute to the special architectural and historic character of the Carnegie Hill Historic District. The Commission further noted that the far right windows on the developed south elevation at the 8th, 12th, and 14th floors were installed prior to designation. With regard to this proposal, the Commission found that that the proposed work will not cause damage to any significant architectural features of the façade; that the position of the new window opening is consistent with the spacing of the original fenestration pattern on this façade, and will therefore reinforce the original fenestration pattern; and that the size of the new opening, and the configuration and operation of the proposed window, will match the size, configuration, and operation of the historic windows on this secondary developed façade. Based on these findings, and the Commission determined the work to be appropriate to the building and the Carnegie Hill Historic District, and voted to approve it. However, the Commission made its determination subject to the stipulation that two sets of Department of Buildings filing drawings be submitted to the Commission for review and approval. Subsequently, on June 13, 2007, the Commission reviewed drawings A-101, A-102 and A-103, dated revised May 22, 2007, prepared by Patrick O'Connell, P.E. The Commission reviewed the drawings and found that the design approved by the Commission has been maintained. Based on this and the above findings, the drawings are being marked approved with a perforated seal, and Certificate of Appropriateness 08-0602 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
