Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 24, 2007, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for work at the subject premises, as put forward in your application
complete on March 29, 2007; and as you were informed in Status Update Letter 07-7815 (LPC 07-5575) issued
on April 24, 2007.

The proposal, as approved, includes the installation of three (3) 12' - 6" wide by 5' deep balconies at the rear
facade, the removal of three (3) windows at the rear facade, dropping the sills to accommodate doors; and the
installation of three (3) multilight doors within the enlarged openings. The proposal was shown on presentation
boards BD.1 and BD.2, consisting of a block plan, current condition photographs, and elevation and section
drawings, dated March 8, 2007, prepared by HH Building Consulting; all presented at the Public Hearing and
Public Meeting. The proposal, as originally presented, called for installing 7' deep balconies.

In reviewing this proposal, the Commission noted that 330 Pearl Street is a Queen Anne style store and loft
building designed by William Kuhler and built in 1882; and that the building's style, scale, materials, and details
are among the features which cause this building to contribute to the special architectural and historic character of
the South Street Seaport Historic District. The Commission further noted that Warning Letter 05-0578 was
issued on May 20, 2005, for "Installation of windows at side elevation without permit(s)"; and that Certificate of
Appropriateness 07-4680 (LPC 06-4042) was issued on December 28, 2006, for the legalization of lot line
windows installed without permit.

With regard to this proposal, the Commission found that the design and placement of balconies on this façade
would resemble fire escape landings, a typical feature on secondary elevations of buildings of this age and type;
that the width and height of the existing window openings will be maintained, and only the sills will be dropped
to allow for the installation of the doors, thereby preserving the existing fenestration pattern on the rear façade;
and that the proposed balconies and altered window openings will only be obliquely visible from a public
thoroughfare, and will not detract from the special historic and architectural character of the building or the
historic district. Based on these findings, and the Commission determined the work to be appropriate to the
building and the South Street Seaport Historic District, and voted to approve it.

However, the Commission made its determination subject to the stipulation that all of the depth of the balconies
be reduced to five feet. Subsequently, on May 10, 2007, the Landmarks Preservation Commission received
drawings BD.1 and BD.2, dated revised April 27, 2007, prepared by John Calvin Hulme, R.A. The Commission
reviewed the drawings and found that the change required by the commission has been made and that the design
approved by the Commission has been maintained. Based on this and the above findings, the drawings are being
marked approved with a perforated seal, and Certificate of Appropriateness 07-9121 is being issued.

Please note that Warning Letter 05-0578, issued on May 20, 2005, for "Installation of windows at side elevation
without permit(s)", will remain in effect until the work approved under Certificate of Appropriateness 07-4680
(LPC 06-4042), including painting the windows, has been completed in compliance with that permit, and
photographs of the completed work are submitted to the Landmarks Preservation Commission along with a
written request for a Notice of Compliance.

PLEASE NOTE: Certificate of Appropriateness 07-4680 contains a compliance date of December 31, 2007. If
you do not complete the work by this date, a second Notice of Violation (NOV) originating from the
Environmental Control Board may be issued in accordance with Title 63 of the Rules of the City of New York,
Section 7-02 (c). This NOV would require a court appearance and a civil fine may be imposed. Once the
corrective work is completed, promptly submit a written request for a Notice of Compliance, along with
photographs documenting the finished work, to the Commission.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
