Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 17, 2007, following the Public Meetings of March 13, 2007 and January 9, 2007, and the Public Hearing of January 9, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on December 14, 2006, and as you were informed in Status Update Letter 07-7646 (LPC 07-2066), issued April 17, 2007. The proposed work, as approved, includes removing the existing non-historic storefront infill and entrance infill on Fifth Avenue and West 40th Street, and installing new curved glass and painted cast iron storefronts with tripartite transoms, and painted metal pin mounted signage attached to the existing stone band above the storefronts, as shown in drawings and photographs labeled 24, 25, 26, 27 and 28, dated November 8, 2006, prepared by Morris Adjmi Architects, submitted as components of the application and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission noted that the designation report states that 452 Fifth Avenue, the Knox Building, is a Beaux-Arts style commercial building designed by John H. Duncan and built in 1901-02. The Commission further notes that the base of the building was altered between 1945 and 1965 when the storefront openings were reduced in width, and the historic projecting, curved storefronts were replaced with flush infill; and that a request for a report to the City Planning Commission, pursuant to Section 74-711 of the Zoning Resolution to permit a modification of bulk pertaining to a new building to be constructed on the same zoning lot, was approved on April 17, 2007, pursuant to LPC 07-1518; and that this Certificate of Appropriateness is being issued in conjunction with that report. With regard to this proposal, the Commission found that the removal of the existing storefronts will eliminate features that detract from the special architectural character of the landmark; that the proposed storefronts are in keeping with the design, details and materials of the historic storefronts; that the reintroduction of the tripartite transoms, projecting storefronts and paneled bulkheads will restore a sense of scale to the base of the building; that pin mounted signage was a common type of signage on late-19th and early-20th century monumental building; and that the proposed storefronts, along with proposed restorative work set forth in LPC 07-3527 and including, repairing masonry, installing a new entrance marquee, installing new windows, and roof repairs, will return the landmark closer to its original appearance. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve this application. In voting to grant this approved, the Commission made its determination subject to the condition that two sets of the final signed and sealed Department of Buildings filing drawings be submitted to the staff of the Commission for review and approval. Subsequently, the staff of the Commission received drawings D201, D202, A001, A201, A202, A203, A204, A205, A206, A207, A208, A301, A302, A303, dated May 31, 2007, and S100 and S101, undated, prepared by Platt Byard Dovell White Architects, LLP, and a gray color sample for the storefronts from Benjamin Moore labeled "Hearthstone" 1601. The Commission reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved by the LPC with a perforated seal and Certificate of Appropriateness 07-5278 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
