Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 24, 2007, following the Public Hearing and Public Meeting of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on March 29, 2007. This permit will expire on April 24, 2013. The work, as approved, consists of removing the existing non-historic storefront and installing a new wood and glass storefront; removing a skylight and constructing a new non-visible roof top addition with a stucco bulkhead and; and at the rear façade, removing the existing fire escapes and installing new balconies at the third through sixth floors. This work was shown in photo boards and drawings P-00, D-101, D-102, D-103, D-301, A-101, A-102, A-103, A-201, A-202, A-301, A-701, A-702, and P-101 through P-104, dated April 17, 2006, revised April 4, 2007, prepared by Michael Zenreich Architect, PC, and submitted as components of the application, and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission notes that the Ladies' Mile Historic District historic district designation report describes 18 West 23rd Street as a commercial building built in 1857 and altered in the early 20th century commercial style in 1924; and that the building's, scale, massing and details are among those features that cause it to contribute to the special architectural and historic character of the Ladies' Mile Historic District. With regard to this proposal, the Commission found that the removal of the existing storefront will not eliminate significant architectural features from the building; that the new storefront will retain the historic cast iron piers and the new infill will fit within the openings framed by these piers; that the configuration, materials and details of the storefront infill are in keeping with storefronts historically found on building of this age and style within the historic district; that the signage will be well scaled to the building, will be located within the signband and will not damage, destroy, or obscure significant architectural features of the building; that the proposed rooftop addition will not be visible from any public thoroughfare; that the proposed rooftop addition will be simple in design and massing and will be in keeping with the form and massing of the building and typical historic rooftop accretions in the Ladies' Mile Historic District; that the rear of the building is not visible from any public thoroughfare; and that the new balconies will not cause the removal of significant building fabric that may have been added over time and that are evidence of the history and development of the building. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Ladies' Mile Historic District, and voted to approve it. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that the height of the transoms be increased and the entry door panels be aligned with the tops of the bulkheads to improve the proportions of the infill; that the display window be moved forward in the storefront opening and that the rooftop addition be pulled back at least three feet from the rear of the building; and that two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and approval. Subsequently, on May 25, 2007, the staff of the Commission received drawings Z-101, D-101, D-102, D-103, D-301, A-101, A-102, A-103, A-201, A-202, A-301, A-310, A-311, A-514, A-701, and A-702, dated April 17, 2006, revised April 25, 2007, prepared by Michael Zenreich, R.A.; S-1through S-3, dated March 10, 2007, prepared by Jack W. Mendelson, P.E.; H1.01, H2.01 through H2.04, H3.00 through H3.07, H4.01, H4.02, and H6.01, FA1.01, FA3.00, FA3.01, FA3.02, FA3.06, FA3.07, FP3.00 through FP3.07, FP5.01, P3.00 through P3.07, and P5.01, dated April 17, 2006, revised May 14, 2007, prepared by Matthew K. Bendix, P.E. The Commission reviewed the submitted drawings and found that proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
