Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of June 27, 2006, following the Public Hearing and Public Meeting of May
23, 2006, voted to approve certain work at the subject premises as put forward in your application completed on
April 27, 2006.

The proposal, as approved, consists of constructing a one-story rooftop penthouse with a glass and metal curtain
wall, steel roof railing, and metal-clad screen wall along the south lot-line wall; demolishing the existing roof-top
water tank, and installing HVAC equipment, as shown in documents entitled "133 Fifth Avenue / June 23, 2006"
prepared by Rogers Marvel Architects, submitted as components of the application and presented at the Public
Hearing and Public Meetings. The proposal as originally presented called for a extending an existing fire stair and
elevator shaft to access the proposed penthouse, with a high, metal-clad stair and elevator bulkhead over the
penthouse, as shown in documents entitled "133 Fifth Avenue / May 23, 2006" prepared by Rogers Marvel
Architects.

In reviewing this proposal, the Commission notes that 133 Fifth Avenue is a neo-Renaissance style store and loft
building designed by Robert Maynicke and built in 1898-99; and that the style, scale, materials and details of the
building are among the features that contribute to the special architectural and historic character of the Ladies'
Mile Historic District.

With regard to this application, the Commission found that the roof of the building has no significant architectural
features which would be lost or damaged as a result of the installation of the proposed mechanical equipment;
that the proposed bulkhead will only be minimally visible from the north in context with an adjacent chimney,
and that its light neutral finish will help it to recede from view; that the cooling tower will be minimally visible
over the rear facade of the building, from a limited vantage point on Broadway, and will therefore, not detract
from the primary facades of the building; that the mechanical equipment will be seen in context with other
chimneys and additions on the adjacent buildings, and therefore, will not call undue attention to itself; and that
the proposed work will not diminish the special architectural and historic character of the building or the Ladies'
Mile Historic District. Based on these findings, the Commission determined the proposed work to be appropriate
to the building and to the historic district and voted to approve it.

The Commission notes that the applicant is applying to the City Planning Commission/Department of City
Planning for certain variances. Any changes to the design required by the City Planning Commission/Department
of City Planning approval must be submitted to the Landmarks Preservation Commission for review and approval
prior to the issuance of the final approval letter.

PLEASE NOTE: This permit is contingent upon the Commission's review and approval of the final Department
of Buildings filing set of drawings. No work can begin until the final drawings have been marked approved by
the Landmarks Preservation Commission with a perforated seal. Please submit these drawings to the Landmarks
Preservation Commission staff when they become available.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
