Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 24, 2007, following the Public Hearing and Public Meeting of
February 27, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises,
as put forth in your application completed on February 1, 2007. This permit will expire on April 24, 2013.

The work, as approved, at the ground floor of the Broome Street and Broadway facades consists of removing the
existing non-historic storefront and installing a new wood and glass storefront with a dark gray (Benjamin Moore
#1617, or equivalent) painted finish; cleaning, repairing, scraping, priming, and painting the cast-iron elements
off-white (Benjamin Moore HC -84, "O'Keefe White," or equivalent); at the Broome Street façade, removing
brick from above the arch in the second bay from the east and installing a new transom window to align with the
transoms of the new storefront infill; and, at the Broadway façade, installing a new yellow painted channel letter
sign reading "SOHO CAFÉ" on a black background within the sign band. This work was shown in photo boards;
material samples; and drawings A-1, dated February 5, 2007, revised March 1, 2007; A-2 through A-4, dated
October 10, 2006, revised March 1, 2007; and AW-1, dated October 10, 2006; prepared by David Turner
Architect, P.C., and submitted as components of the application, and presented at the Public Hearing and Public
Meetings. The proposal, as originally presented, called for the removing brick from above the arch in the second
bay from the east on Broome Street and installing a glass display window and transom; and removing the
sidewalk hatch and installing metal rails to allow for a secondary means of egress from the basement in the third
bay from the east on Broome Street; as shown in photo boards and drawings A-1, dated February 5, 2007; A-2
and A-3, dated October 10, 2006, revised January 29, 2007; and A-4, dated March 10, 2006.

In reviewing this application, the Commission noted that the SoHo-Cast Iron Historic District designation report
describes 444 Broome Street; a.k.a. 489 Broadway, as an Italianate style factory and store building built in 1860;
and that the building's style, scale, materials, and details are among those features that contribute to the special
architectural and historic character of the SoHo-Cast Iron Historic District. The Commission also noted that
Notice of Violation (NOV) 01-0637 was issued July 17, 2001, for "alterations to corner shopfront, including
painting, without LPC permits;" that NOV 01-0638 was issued July 17, 2001, for "installation of through-wall air
conditioner unit, louver, and security camera at ground floor of Broome Street facade without LPC permits;" that
NOV 01-0639 was issued July 7, 2001, for "alterations to the western-most Broome Street storefront, including
painting, without LPC permits;" that NOV 01-0640 was issued July 7, 2001, for "installation of signage ("SoHo
Psychic"), neon and lighting at western-most Broome Street shopfront without LPC permits;" that NOV 01-0641
was issued November 12, 2002, for "installation of signage ("Access Plumbing & Heating Corp.") at
western-most Broome Street shopfront without LPC permits;" that NOV 01-0642 was issued July 17, 2001, for
"alterations to 2nd western-most Broome Street shopfront, including painting, and the installation of lighting,
security roll-down gates with exterior housing and flagpoles with banner ("Silver Square") without LPC permits;"
that NOV 02-0273 was issued March 6, 2003, for "painting the 2nd western-most Broome Street shopfront
(Silver Square) without LPC permits;" and that Warning Letter 03-0158 was issued August 26, 2002, for
"installation of a curbside pay telephone at 442-444 Broome Street in non-compliance with Permit for Minor
Work 99-3832." The Commission also noted that an escrow account was established and PMW 07-4902 was
issued January 8, 2007, to allow work to correct violations cited under NOVs 01-0637, 01-0638, 01-0639,
01-0640, 01-0641, 01-0642, and 02-0273 at the subject premises.

With regard to this proposal, the Commission found that the removal of the existing storefronts and the partial
removal of brick above the arched panel will not cause the removal of significant building fabric and will help to
unify the storefront; that the new storefront will retain the historic cast iron piers and low arched panel, and that
the new infill will fit within the openings framed by these piers; that the new storefront infill will increase the
transparency of the ground floor of the Broadway and Broome Street facades; that the configuration, materials
and details of the storefront infill are in keeping with storefronts historically found on building of this age and
style within the historic district; and that the signage will be well scaled to the building, will be located within the
signband and will not damage, destroy, or obscure significant architectural features of the building. Based on
these findings, the Commission determined the proposed work to be appropriate to the building and to the
SoHo-Cast Iron Historic District, and voted to approve it.

However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department
of Buildings, be submitted to the staff of the Commission for review and approval.

Subsequently, on April 24, 2007, the staff of the Commission received drawings A-1, dated February 5, 2007,
revised March 1, 2007; A-2 through A-4, dated October 10, 2006, revised March 1, 2007; and AW-1, dated
October 10, 2006; prepared by David H. Turner, R.A. The Commission staff noted that the drawings included
additional work including, installing retractable red colored canvas awnings without side panels affixed to the
new wood storefront infill at the Broome Street and Broadway facades; interior alterations, including the
demolition and construction of interior non-bearing partitions and finishes at the ground floor. With regard to the
additional work, the Commission finds, in accordance with the criteria set forth in Title 63 of the Rules of the
City of New York, Section 2-12, that the proposed awnings will be retractable; that the attachment of the awning
will not cause the loss of, or damage to, or hide or obscure any significant architectural features; that the awning
will be installed directly below the lintel; that the length of the awning does not exceed the length of the
storefront opening and the edges of the awning are aligned as closely as possible with the inside face of the cast
iron piers of the storefront opening; that the underside of the awning is open; ; that the awnings will be clad with
water repellant canvas with a matte finish; and that the awning fabric will be a solid color. The Commission
reviewed the submitted drawings and found that proposal approved by the Commission has been maintained.
Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this
Certificate of Appropriateness is being issued.

Please note that NOVS 01-0637, 01-0638, 01-0639, 01-0640, 01-0641, 01-0642, and 02-0273, and Warning
Letter 03-0158, all remain in effect against the property; that NOVs, 01-0639, 01-0640, 01-0641, 01-0642, and
02-0273, will be rescinded when the work approved under PMW 07-4902 has been completed and inspected for
compliance; that NOVs 01-0637 and 01-0638 will be rescinded when work completed under both PMW 07-4902

and this Certificate of Appropriateness have been completed. Please notify the Landmarks Preservation
Commission staff when the work has been completed, and send clear color photographs of the completed work
and a letter to the Commission requesting that a Notice of Compliance be issued. This permit does not address
Warning Letter 03-0158.

PLEASE NOTE THAT THIS PERMIT CONTAINS A COMPLIANCE DATE OF December 31, 2007.

If you do not complete the work by this date, a Notice of Violation (NOV) originating from the Environmental
Control Board may be issued in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c).
This NOV would require a court appearance and a civil fine may be imposed.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
