Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of May 8, 2007, following the Public Hearing of April 24, 2007, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed on March 29, 2007.

The proposed work, as approved, consists of legalizing the installation of GFRC cladding over historic building
fabric above the Madison Avenue storefront in non-compliance with Certificate of No Effect 07-2723, as shown
in photographs of the existing conditions, the work in progress, and the building circa 1940, and a late 19th
century rendering of the building, submitted by the applicant as components of the application, and presented at
the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the designation report states that 1236 Madison Avenue,
a.k.a. 18-22 East 89th Street, is a Romanesque Revival style apartment hotel designed by Thomas Graham and
built in 1891-93; and that the style, design, scale, details, and materials of the building are among the features
which contribute to the special architectural and historic character of the Carnegie Hill Historic District. The
Commission further notes that the base of the Madison Avenue façade was altered prior to 1940 when a storefront
was installed; that the base of the Madison Avenue façade was covered with stucco at the time of designation;
that upon removal of the stucco, portions of the original limestone façade, including the tops of three arches and
carved panels, were uncovered; that Certificate of No Effect 07-2723 was issued October 11, 2006 for installing a
new storefront and recladding the base on Madison Avenue; and that Warning Letter 07-0322 was issued
February 5, 2007 for work in non-compliance with Certificate of No Effect 07-2723.

With regard to this proposal, the Commission found that the remnants of the historic limestone arches are in poor
condition and missing much of the original fabric, and therefore, covering them with new material would not
conceal a significant architectural feature of the façade; that the Madison Avenue façade of the building has been
so highly altered at the base, that the arch remnants do not relate architecturally to the historic storefront opening
below them, and thus exposing them would not create a harmonious design at the base of the building; that the
arch remnants will remain under new the material, so covering them would not preclude restoring them in the
future; and that the work is in keeping with the historic commercial character of Madison Avenue. Based on these
findings, the Commission determined the proposed work to be appropriate to the building and the historic district,
and voted to approve this application.

Warning Letter 07-0322 is rescinded with the issuance of this permit.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
