| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of February 27, 2007, following the Public Hearing of February 27, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on February 1, 2007. The work approved consists of the creation of a new window opening featuring a diamond-paned leaded glass window on the ground floor of the west-facing facade, in an area of masony with a distinctive bond pattern and visible from the street. The proposal, as originally presented, included a wider window opening with a pointed head. The proposal is shown in drawings A0.0, A1.0, A1.1, A2.0, A2.1, A2.2, and A3.0, all dated January 23, 2007, showing the west facade, south facade, detail drawings, interior elevations, photographs of the existing conditions of the building and the streetscape, and an historic photograph of the building, all prepared by Acheson Doyle Partners Architects, P. C., and presented at the Public Hearing and the Public Meeting. In reviewing this proposal, the Commission noted that the Upper East Side Historic District Designation Report describes 53 East 77th Street as a house built in 1900-01 and redesigned in the neo-Spanish Renaissance style by Pleasants Pennington in 1926-27. The Commission also noted that Certificate of Appropriateness 98-6960 was issued on June 29, 1998, for the construction of a rear yard addition, the installation of new multi-light casement windows at the front facade on the third floor, and restoring the diamond pane windows on the western facade; and that Certificate of Appropriateness 99-5914 was issued on May 5, 1999, for the installation of a glass and metal canopy over the main entrance. With regard to this proposal, the Commission found that the new leaded glass window will match the materials, details, and finish of other windows on this facade; that the proposed work will not involve the removal of carved stonework or molded brick, and the special bond pattern can be easily recreated if the window opening is closed in the future; that the opening will align with the other visible openings in this bay on other floors on this facade, and it will not detract from the fenestration on the front facade; and that the proposed work will not diminish the special architectural character of the building and the Upper East Side Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Upper East Side Historic District, and voted to approve it. However, in voting to grant this approval, the Commission made its determination subject to the following conditions; 1. that the shape of the window be modified to match the square-headed windows on the upper floors in this bay; 2. and that two sets of signed and sealed Department of Building construction drawings be submitted to the Commission for review. On May 14, 2007, the staff of the Commission received the requested drawings, A0.0, A1.0, A1.1, A2.0, A2.1, and A3.0, all dated April 10, 2007, prepared by Acheson Doyle Partners Architects, P. C. Staff has reviewed these materials and finds that the proposal, with the modification determined by the Commissioners, has been maintained in the filing drawings. Based on this and the approved findings, Certificate of Appropriateness 07-8524 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
