| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 31, 2006, following the Public Hearing of the same date, voted to approve a proposal to construct a rooftop garden at the subject premises, as put forward in your application completed on September 28, 2006 and as you were notified in Status Update Letter 07-3374 (LPC 070629), issued October 31, 2006. The proposal, as approved, consists of the installation of 9' tall posts at the roof, supporting a curtain system featuring white vinyl mesh fabric; and the installation of concrete pavers and plantings at the roof deck; as shown on presentation boards labeled 1 through 17, dated October 5, 2006 featuring photomontages, site line drawings and material samples. In reviewing this proposal, the Commission noted that 36-40 Gansevoort Street is a building designed by Morris Adjmi and built in 2004-2005. The Commission also noted that Certificate of No Effect 06-7312 (LPC 065983), was issued April 14, 2006, for the construction of an elevator and stair bulkhead; that Commission Denial 06-1475 (LPC 058536), was issued August 23, 2005, for the construction of a rooftop bulkhead, and that Certificate of Appropriateness 04-5703 (LPC 045058),was issued March 16, 2004, for the removal of the facade and the top floor of the existing two-story building, the construction of a four-story addition, and the construction of a new facade. With regard to this proposal, the Commission found that the proposed addition will be installed in a manner which is easily reversible; that the proposed railing and screen will be consistent with the visibility of other rooftop features in this historic district; that because of the evolution of buildings in the historic district and the unusual street layout, many rooftops are visible and therefore the visibility of this railing will be consistent with the visibility of other rooftop features in the district; and that the diaphanous fabric will be ephemeral and translucent and will therefore diminish the presence of this installation on the roof. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Gansevoort Market Historic District, and voted to approve it. However, in voting to grant the approval, the Commission required that two complete sets of signed and sealed Department of Buildings filing drawings be submitted for review and approval. Subsequently, on April 12, 2007, the staff received drawings labeled L0.0, L1.0, L2.0, L3.0, L3.1, L4.0, L5.0, L5.1, L5.2, L6.0, L6.1, L6.2, L7.0, L7.1, L8.0, and L8.1, all dated April 10, 2007, prepared by Kenneth W. Smith, L.A. Accordingly, the staff reviewed these drawings and found that the proposal has been revised to include stainless steel mesh curtain panels instead of the white vinyl fabric. Staff reviewed this revision and found that the open stainless steel mesh will have a neutral matte finish and a transparent quality; that the revision is in keeping with the intent of the original approval; and that otherwise the proposal approved by the Commisison has been maintained. Therefore these drawings have been marked approved by the LPC with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
