Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 8, 2007, following the Public Hearing of the same date, voted to approve a proposal for the installation of one through wall air conditioning unit on the Madison Avenue facade at the third floor, as put forward in your application completed on March 29, 2007. The proposed work, as approved, consists of the removal of a plain limestone panel set into the facade, located behind projecting decorative metal grilles, below a window at the third floor of the Madison Avenue façade; and the installation of a rimless architectural grille mounted flush with the façade and painted to match the surrounding masonry; as shown in existing conditions photographs, and drawings labeled 100 through 102, dated March 19, 2007, prepared by AZAR Associates, and floorplan, written information, prepared by Hamilton Air Co., submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission notes that the designation report describes 14 East 90th Street as a neo-Renaissance style apartment building, designed by J.E.R. Carpenter and built in 1928-29; and that the building's style, scale and materials are among the features which cause this building to contribute to the special architectural and historic character of the Carnegie Hill Historic District. The Commission also notes that the through-wall HVAC sleeves, which penetrate decorative limestone bands at the third floor, were installed prior to designation. With regard to this proposal, the Commission found that only flat, non-decorative areas of the limestone façade will be removed; that the louvers will be screened by the decorative metal railing; that the rimless louver will be set flush with the façade and painted to match the surrounding limestone; and that similar openings have been created at other windows on this floor. Based on these findings, the Commission determined that the proposed work is appropriate to the building and the historic district, and therefore voted to approve this application. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
