| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of April 17, 2007, following the Public Hearing of the same date, voted to approve the proposed work at the subject premises, as put forward in your application completed on March 17, 2007, and as you were informed in the Status Update Letter issued on April 17, 2007 (SUL 07-7642, LPC 07-6143). The approval will expire on April 17, 2013. The proposed work, as approved, consists of modifications of window openings on the visible rear elevation at the eleventh floor, including the removal of masonry from below four (4) window openings at the eleventh floor of the rear elevation; and the installation of metal casement windows with transoms within the enlarged openings; and the removal of the fire exit door and transom and replacement with a single, multi-paned steel door, painted Benjamin Moore HC-10 (van buren brown); as shown in existing condition photographs, paint chip, and drawings labeled L01 through L05, dated March 7, 2007, prepared by Steven Learner, R.A., submitted as components of the application, and presented at the Public Meeting and Public Hearing. In reviewing this proposal, the Commission noted that the Ladies' Mile Historic District designation report describes 12 West 17th Street as an early 20th Century Commercial style building designed by Schwartz & Gross and built in 1911-1912; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the building and the Ladies' Mile Historic District. With regard to this proposal, the Commission found that the modifications will not cause the removal of decorative brickwork or alter significant features of the building; that the window enlargement will be consistent across the entire floor and will only be seen in conjunction with the floor above, which will minimize any disruption of this secondary facade; that the enlarged openings will retain the original width and head height and will therefore maintain the relationship to the windows above; that the multi-light configuration of the proposed windows will relate to the windows above; and that the fire escape will largely conceal the changes to the openings from most point of view; and that the proposed work will not detract from the special architectural and historic character of the Ladies' Mile Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that two final signed and sealed copies of the Department of Buildings filing drawings for the approved work be submitted to the staff of the Commission for review and approval. Subsequently, on April 30, 2007, the Landmarks Preservation Commission received final drawings labeled L01 and L02, dated March 7, 2007 and prepared by Steven Learner, R.A. Accordingly, staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings are marked approved with a perforated seal, and Certificate of Appropriateness 05-7506 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
