Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of March 6, 2007, following the Public Hearing, voted to grant a Certificate
of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on
February 8, 2007. This permit will expire on March 6, 2013.

The work, as approved, consists of removing the existing metal and glass storefront infill, and installing new
metal storefront infill featuring clear glass display windows, glass transom, and metal paneled bulkhead with a
baked on dark green finish. This work was shown in photo boards, drawings and material samples, and photo
montages, on four presentation boards labeled 1 through 4, dated February 14, 2007, prepared by Curtis and
Ginsberg Architects, and submitted as components of the application, and presented at the Public Hearing and
Public Meeting.

In reviewing the application, the Commission noted that the Tribeca South Historic District designation report
describes 146 Duane Street as an Italianate style store and loft building built in 1859-1860; and that the building's
scale and materials are among the features that contribute to the special architectural and historic character of the
Tribeca South Historic District.

With regard to this proposal, the Commission found that the proposed work will not involve the removal of
original building fabric; that the proposed storefront openings are defined by existing piers, and that the new
storefront infill will fit within these piers and will maintain a rhythm which relates to the facade above; that the
configuration and proportions of the storefront, with transoms and paneled bulkheads, are in keeping with the
historic storefronts found within the historic district; that the proposed storefront will maintain transparency at the
ground floor that is an important feature found historically on buildings within this historic district; that the
proposed color of the storefront framing will help to unify the building as a whole; and that the proposed back
painted signage is simple and unobtrusive, and will not call undue attention to itself. Based on these findings, the
Commission determined that the work is appropriate to the building and to the historic district, and voted to
approve this application.

However, in voting to grant this approval, the Commission made its determination subject that two sets of final
signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be
submitted to the staff of the Commission for review and approval.

Subsequently, on April 9, 2007, the staff of the Commission received drawings A100 and A300, dated January
19, 2007; last revised March 7, 2007, prepared by Roberta Darby Curtis, R.A. The Commission staff noted that
the drawings included painting the cast iron columns a light gray color, and the demolition and construction of
interior non-bearing partitions and finishes. Staff finds that the proposed work will restore the building closer to
its historic appearance and will aid in the long term preservation of the building; and that the proposal approved
by the Commission has been maintained. Based on these and the above findings, these drawings are being marked
approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
