Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of April 3, 2007, following the Public Hearing of the same date, voted to
deny the legalization of fixed awnings installed at the ground floor, and the corner entrance, without Landmarks
Preservation Commission permits; and to approve the legalization of a retractable awning installed at the
easternmost storefront on the West 58th Street façade without a Landmarks Preservation Commission permit, at
the subject premises, as put forward in your application completed on March 8, 2007.

The work denied consists of legalizing the installation of fixed canvas awnings within square-headed window
openings on 7th Avenue and West 58th Street, two arch-headed window openings flanking the corner entrance,
and the corner entrance. The work approved consists of legalizing the installation of a retractable canvas awning
above the easternmost storefront on the West 58th Street façade clad in blue and beige canvas, as shown in
photographs of the existing conditions, a circa 1940 photograph, and a 1980's photograph, submitted by the
applicant as components of the application, and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the designation report states that 182 West 58th Street,
Alwyn Court, is a French Renaissance style apartment building designed by Harde and Short and built in
1907-09; and that the building's style, scale, design, details, and materials are among the features which cause this
building to contribute to the special architectural and historic character of this Individual Landmark. The
Commission also noted that Warning Letter 05-0621 was issued June 14, 2005 for installing awnings without
permits; and that Certificate of Appropriateness 83-0735 was issued April 11, 1983 for the installation of fixed
awnings over first floor windows, and denying the installation of a fixed awning at the corner entrance.

With regard to the legalization of the awnings installed in the square- and arch-headed openings, and the
entrance, the Commission found that the square-headed window awnings are not retractable, have fixed skirts
with signage, side panels, and shallow slopes, and thus do not recall the appearance of historic residential
awnings; that the entrance awning obscures the ornamental entrance, a significant architectural feature of the
building; that the awnings in the round-headed openings flanking the entrance do not conform to the shape of the
openings; that these fixed, waterfall-type awnings with tightly fitted fabric, do not recall the shape and loose,
flexible appearance of the type of retractable awnings that were historically installed in rounded openings; that
the installation of lighting under the awnings is not typical of historic awning installations; and that the presence
of the awnings detracts from the highly ornate facades of this landmark. Based on these findings, the Commission
found that this portion of the application was inappropriate, and voted to deny it.

With regard to legalizing the retractable awning over the West 58th Street storefront, the Commission found that
the awning is retractable, has an unframed skirt, and does not conceal any significant features; that the length of
the awning does not exceed the storefront opening, and the underside is open; that it is clad in canvas and
harmonizes with the historic color palette of the building; and that it has the profile and appearance of a historic
awning. Based on these findings, the Commission determined the legalization of the West 58th Street storefront
awning to be appropriate to the landmark, and therefore voted to approve this portion of the application.
Certificate of Appropriateness 07-7477 is therefore being issued.

Please note that Warning Letter 05-0621 remain in force against this property. Failure to address this violation
immediately may result in the issuance of a Notice of Violation originating from the Environmental Control
Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). This NOV would
require a court appearance and a civil penalty may be imposed.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
