Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 9, 2007, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your
application completed on December 14, 2006.

The work, as approved, consists of the construction of a one-story metal and glass clad rooftop addition, set back
from the parapet, and associated mechanical equipment and related interior alterations; and the removal of an
existing fire escape on the front façade; as shown in on-site constructed mockups, photo boards, material samples
and 12 presentation boards labeled PB 01 through PB11 and LPD12, dated November 29, 2006, prepared by
Tirmizi Campbell Inc., submitted as components of the application and presented at the Public Hearing and
Public Meetings.

In reviewing the proposal, the Commission noted that the Tribeca West Historic District designation report
describes 159 Duane Street as an Italianate style store and loft building built in 1855-1856; and that the building's
style, scale and materials are among the features that contribute to the special architectural and historic character
of the Tribeca West Historic District.

With regard to this proposal, the Commission found that the construction of the proposed rooftop addition will
not result in any damage to, or demolition of, any significant architectural features of the roof; that the simple
design and use of red brick will be harmonious with the materials and color palette of the building and will be in
keeping with the presence of utilitarian rooftop additions found throughout the historic district; that the
fire-escape is not original to the building and is not decorative; therefore, its removal will not eliminate a
significant historic feature; that the installation of the fire escapes has compromised and damaged the brownstone
façade; and its presence obscures the details of the façade, and therefore its removal will allow for repairs to the
façade and restoration of significant stone details; and that the proposed work will not detract from the special
architectural and historic character of the building. Based on these findings, the Commission determined the
proposed work to be appropriate to the building and the Tribeca West Historic District, and voted to approve it.

However, in voting to grant this approval, the Commission made its determination subject that the rooftop
addition be further set back and lowered in height to reduce visibility, and that two sets of final signed and sealed
drawings showing the approved proposal, which shall be filed with the Department of Buildings, be submitted to
the Landmarks Preservation Commission for review and approval.

Subsequently, on March 23, 2007, the Commission received two sets of final drawings labeled A001, A002,
A003, D101, D102, D103, D104, A101, A102, A103A104, A401, A402, A403, A404, dated March 6, 2007,
prepared by Scott Robert Campbell, R.A. The Commission staff noted that the drawings included additional
work, including a restorative program to including cleaning, repointing and repairing the brownstone facade;
replacing missing and damaged cast iron elements at the ground floor in kind; scraping, priming and painting
priming, painting the cast iron in fill, based an historic paint analysis; removing modern infill at the westernmost
bay and installing wood and glass doors to match the historic infill, based on photo documentation and physical
evidence; repointing brick work at the rear (north) and west elevations; replacing the roofing system in kind; and
the demolition and construction of interior non-bearing partitions and finishes. Staff finds that the proposed work
will restore the building closer to its historic appearance and will aid in the long term preservation of the building;
and that the proposal approved by the Commission has been maintained. Based on these and the above findings,
these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of
Appropriateness is being issued.

This permit is issued contingent upon the Commission's review and approval of brick and mortar, Dutchman
repair, patching samples, and brownstone samples, and any shop drawings for windows and door replacement, all
prior to the commencement of work. Please contact the Landmarks Preservation Commission staff to arrange a
site visit.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
