Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of December 12, 2006, following the Public Hearing of the same date, voted
to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your
application completed on November 16, 2006. This permit will expire on December 12, 2012.

The work, as approved, consists of alterations at the areaway, including, removing the existing retaining walls,
concrete paving, cellar hatch, and railings; and extending the areaway approximately two (2) feet into the
sidewalk, building new brownstone walls with bluestone caps, installing two (2) new brownstone stairways with
bluestone treads, installing a new planter; installing new bluestone pavers; and installing a new decorative metal
railing and gates; and alterations at the ground floor of the façade, including removing the northmost window,
lowering the sill, and installing a new wood and glass door; and removing the existing brass main entry doors and
installing a new, wood double door in the existing opening. This work was shown in photo boards; material
samples; and drawings A-1, A-2, A-6A-7, A-9, A-10a, and A-47; prepared by John Bradley Springer, R.A., and
submitted as components of the application, and presented at the Public Hearing and Public Meeting

In reviewing this application, the Commission noted that the Upper East Side Historic District designation report
describes 40 East 73rd Street as a neo-Grec style rowhouse built in 1885-1886; and that the building's style, scale,
materials, and details are among those features that contribute to the special architectural and historic character of
the Upper East Side Historic District.

With regard to this proposal, the Commission found that the new areaway will align with adjacent areaways and
help to restore the historic lot line of the row; that the alterations to the areaway will not prevent preclude
reconstructing the stoop; that the height, scale, and placement of the areaway railing will relate well to the historic
ironwork and be in keeping with ironwork at buildings of this type, style and age, and will harmonize with the
streetscape; that the removal of the plain brownstone window sill and the installation of a secondary entrance
door will not result in the loss of decorative masonry; that the replacement of the window with a secondary
entrance door will maintain the transparency and fenestration pattern of the facade; that the new secondary
entrance door will be subordinate to the main entrance door and will read as a service entrance which is a
common feature found on other altered rowhouses within the Upper East Side Historic District; that the simple
design of the new paneled main entry doors relates to other doors already present on the block; and that the new
secondary entry door, areaway, and entry door will not detract from the significant architectural features of the
building or adjacent building by virtue of their proximity to such features. Based on these findings, the
Commission determined that the work is appropriate to the building and to the historic district, and voted to
approve this application.

However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department
of Buildings, be submitted to the staff of the Commission for review and approval.

Subsequently, on March 7, 2007, the staff of the Commission received drawings A-1, A-2, A-5a, A-6, A-7, A-8,
A-8a, A-9, A-10a, A-47, A-47a A-69 and A-70, prepared by John Bradley Springer, R.A. The Commission
reviewed the submitted drawings and found that proposal approved by the Commission has been maintained.
Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this
Certificate of Appropriateness is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
