| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 9, 2007, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises as put forward in your application completed on December 7, 2006. This approval will expire on January 9, 2013. The proposal, as approved, consists of modifying the existing window openings on the visible rear elevation so the windows align with each other, installing two-over-two, double- hung wood windows; installing a vertical line of three new window openings with two-over-two, double-hung windows at the southern end of the Water Street facade; and installing a wood storefront at the ground floor corner consisting of paneled bulkheads, display windows with double-light transoms and a pair of fixed, paneled, wood-and-glass doors at the recessed chamfered entrance as shown in an historic photograph, existing-condition photographs, photo montages, color samples and drawings A-013 dated September 21, 2006; A-018 and A-200a dated revised January 2, 2007, prepared by Allen Shinfeld, engineer, submitted as components of the application and presented at the Public Hearing and Public Meeting. As originally presented, the proposal included a second line of windows at the northern end of the Water Street facade. In reviewing this proposal, the Commission noted that the Vinegar Hill Historic District Designation Report states that 69 Gold Street is rowhouse building between 1841 and 1852 and altered in 1906 and 1921; and that the building's style, scale, materials and details are among the features which cause it to contribute to the special architectural and historic character of the historic district. With regard to the proposed storefront, the Commission found that the installation of the proposed storefront will not result in demolition of or damage to any original building fabric, and will eliminate modern infill that detracts from the special architectural and historic character of the building and the streetscape; that the proposed storefront will return transparency to the commercial ground floor, which is an important feature of mixed-use 19th-century buildings; that the proposed storefront will return the traditional relationship between the commercial base of the building and the residential upper floors; and that the proposed storefront, in terms of its design, details, material and finish will recall those storefronts historically found at buildings of this type and design. With regard to the proposed modification of existing window openings and the creation of new window openings, the Commission found that the proposed window openings and new sash will retain the same general shape and pattern as the existing window and the proposed sash will match the original sash in terms of configuration, operation, details and finish; that the proposed modified window openings on the rear facade will blend harmoniously with the window openings on the houses of the adjoining row to the east; that the proposed small window openings on the side facade will recall the small window openings on many 19th-century residential buildings, usually bathrooms, that were added to the buildings over time and are evidence of the development of the buildings; and that the installation of a limited number of additional windows on the side facade will not detract from the special architectural and historic character of the building or the streetscape. Based on these findings, the Commission determined the work to be appropriate to the building and to the historic district and voted to approve it. However, the Commission made its determination with the stipulations that one of the line of windows proposed at the Water Street facade be eliminated from the proposal; and that two sets of final, signed and sealed Department of Buildings' filing drawings be submitted to the Commission for review and approval. Subsequently, the Commission received drawings A-200a, A-200b and A-200c dated February 1, 2007, prepared by Allen Shinfeld, engineer. Accordingly, the staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal and Certificate of Appropriateness 07- 6568 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
