Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 23, 2007, following the Public Hearing of the same date, voted to
grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your
application completed December 28, 2006, and as you were informed in Status Update Letter 07-5248 (LPC
06-7765), issued January 24, 2007.

The proposed work, as approved, consists of alterations to the ground floor of the Broadway facade, including
removing the existing recessed entrance, shopfronts, a panel above the entrance and shopfronts, security
roll-down gates and an awning; removing cladding from and repainting existing cast iron piers; installing new
painted wood and glass shopfront and entrance infill, featuring paneled wood bulkheads and transoms, within the
restored openings; and installing a wood sign band and non-illuminated signage, featuring a black painted sign
panel with yellow lettering. The work was shown on presentation boards, labeled A-1, A-2 and A-3, dated
revised January 9, 2007 and consisting of drawings and one photograph; an unlabeled board consisting of current
condition photographs and prepared by David Turner; and one circa 1930s photograph, prepared by the
Commission staff, all presented at the Public Hearing and Public Meetings.

In reviewing this proposal, the Commission noted that the Ladies Mile Historic District Designation Report
describes 870 Broadway (aka 30 East 19th Street) as a altered Italianate style rowhouse built circa 1860; and that
the building's style, scale, materials and details are among the features that contribute to the special architectural
and historic character of the historic district. The Commission also notes that Warning Letter 00-0101 was issued
August 30, 1999 for the "installation of fixed awning ("OH Jewelry Co.") and painting of southern ground floor
shopfront of Broadway facade without permit(s)" and advanced to a Notice of Violation on June 25, 2004.

With regard to this proposal, the Commission found that the replacement of the existing storefront and entrance
infill and removal of exterior security roll-down gates and awning will eliminate elements which detract from the
significant architectural features of the building, without causing the removal of any significant, historic fabric;
that uncovering the concealed historic piers and defining the shopfront and entrance by the original piers and
lintels will reveal significant, historic fabric and return the shopfront and entrance to their historic size and
placement; that the configuration and design of the proposed shopfront, featuring display windows, paneled
bulkheads, and transoms, will recall the organization and details of historic shopfronts at buildings of this type,
style and age and will be well related to shopfronts within this row and throughout the district; that the divisions
of the display windows and transoms will reflect the rhythm of the fenestration at the upper floors, thereby
harmonizing with the building; that the entrance will be well integrated into the overall ground floor alterations
and in keeping with the character of the building; that the materials and finish of the shopfront and entrance will
be in keeping with the historic materials and color palette of these elements at buildings of this type, style and
age; that the proposed sign band will re-introduce an element which has been removed from the facade; that the
signage will be non-illuminated, limited in length to the width of the shopfront opening, and well scaled to the
building, thereby serving as a harmonious, secondary element; and that the work will support the special
architectural and historic character of the Ladies' Mile Historic District. Based on these findings, the Commission
determined the work to be appropriate to the building and the historic district and voted to approve the
application with the stipulation that the shopfront and entrance infill be set back between 4" to 6" from the
exterior face of the cast iron piers.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two sets of signed and sealed Department of Building filing drawings showing the approved design.

Subsequently, on February 1, 2007 and February 23, 2007, the Commission received a paint chip for the cast iron
piers and sign band and final drawings A-1 and A-3, dated revised February 22, 2007 and drawing A-2, dated
revised January 9, 2007 and prepared by David H. Turner, RA.

Accordingly, staff reviewed these materials and noted that they include additional work, consisting of interior
alterations at the first floor. Additionally, photographs, submitted by David Turner, RA, as part of the Public
Hearing presentation, document that the white-painted southern shopfront has been repainted a reddish brown
color to match the remainder of the ground floor and that the fixed awning has been removed. With regard to this
work, staff found that the painting and removal of the awning has eliminated elements that detract from the
facade, without altering any significant features of the building. Additionally, staff found that the design
approved by the Commission has been maintained and the change required by the Commission has been included.
Based on these and the above findings, Notice of Violation 00-0101 is hereby rescinded; the filing drawings have
been marked approved with a perforated seal; and Certificate of Appropriateness 07-6999 is being issued.

PLEASE NOTE: This permit is issued contingent upon the submission of documentation of the condition of all
three of the cast iron piers; and the approval by the Commission of a paint chip for the finish of the shopfront
infill and a proposal to repair and or replace the cast iron piers if any of the piers are found to be missing or
damaged, all prior to the commencement of work.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
