Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of of September 12, 2006, following the Public Hearing of September 12,
2006, voted to grant a Certificate of Appropriateness for the proposed for work at the subject premises, as put
forth in your application completed on August 17, 2006.

The proposal, as approved, consists of the demolition of an existing elevator bulkhead and stair bulkhead, and the
construction of a one-story rooftop addition and stair and elevator bulkhead, all clad in tan-colored stucco, as
shown in drawings LPC-01 through LPC-16, which included an historic photograph, photographs of the existing
conditions, existing and proposed elevations, existing and proposed sections, details, and photo montages, all
dated August 24, 2006, prepared and submitted as components of this application by McKay Architecture/Design
PLLC.

In reviewing this proposal, the Commission noted that the Tribeca East Historic District Designation Report
describes 105 Franklin Street as a Second Empire style store and loft building designed by Alexander G. Culter
and built in 1867; and that its style, scale, materials, and details are among the features which contribute to the
special architectural and historic character of the building, the street, and the Tribeca East Historic District. The
Commission also noted that Certificate of Appropriateness 06-5340 was approved on March 20, 2006 approving
the construction of a stair and elevator bulkhead.

With regard to the proposed changes to the rooftop addition, the Commission found that construction of the
rooftop addition will not cause the destruction of any significant historic fabric; that because of the simple
massing, detailing, and stucco finish, the proposed enlargement of the visible stair and elevator bulkhead will not
add overwhelming bulk to the roof of this building; that because the bulkhead will only be visible against the
backdrop of other buildings at an acute angle, enlarging it by three feet will not detract from the significant
features of the facade or the streetscape; that the enlarged stair and elevator bulkhead will conceal the occupiable
portion of the addition when seen from the north in conjunction with the primary facade, minimizing its impact
upon the skyline and the significant protected features of the building; that the rooftop addition, when seen from
the west, will only be minimally visible in conjunction with the rear facade, and the rear facades of adjacent
building's, minimizing its impact upon the building and the streetscape; and that for these reasons, the proposed
construction of the rooftop addition is in keeping with the building, the streetscape, and the Tribeca East Historic
District. Based on these findings, the Commission determined the proposed work to be appropriate to the
building, and voted to approve it.

However, the Commission made its determination to approve the proposal subject to the following condition: that
two sets of signed and sealed Department of Building filing drawings showing the approved work be submitted to
the Commission for review.

On February 9, 2007, the Commission received drawings BD-001, Z-001, BD-002, BD-003, BD-011.2,
BD-016.2, BD-018.2, BD-106, BD-107, BD-200, BD-201, BD-207, BD-208, BD-300, and BD-902, all dated
December 5, 2006, S-7, S-8, and S-9, all dated November 29, 2006, P-7, P-8, and P-9, all dated September 8,
2006, all prepared by McKay Architecture/Design PLLC.

Staff has reviewed these materials and finds that the proposal approved by the Commission have been
maintained. Based on this and the approved findings, Certificate of Appropriateness 07-6861 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
