Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of January 9, 2007, following the Public Meeting and Public Hearing of
December 5, 2006, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises,
as put forward in your application completed on November 9, 2006, and as you were informed in Status Update
Letter 07-4978 (LPC 07-0196), issued January 10, 2007.

The proposed work, as approved, includes removing an existing one-story rear extension and constructing a
two-story brick clad rear addition at the basement and first floor, as shown in drawings and photographs labeled
LPC1 through LPC9, revised December 20, 2006, and LPC10, dated December 5, 2006, prepared by DeLacour
and Ferrara Architects, and presented at the Public Hearing and Public Meetings. The proposal, as initially
presented to the Commission featured a stucco clad addition with a set back second story and a lot-line window,
as shown in drawings and photographs labeled LPC1 through LPC9, dated December 5, 2006, prepared by
DeLacour and Ferrara Architects.

In reviewing this proposal, the Commission noted that the designation report states that 39 Sidney Place is a
Greek Revival style rowhouse built in 1846.

With regard to this proposal, the Commission found that the proposed addition will not be visible from any public
thoroughfare; that the removal of the existing rear extension and the construction of the proposed addition will
not result in damage to, or demolition of any significant architectural features; that the proposed addition will not
rise to the full height of the rear façade, thereby preserving the historic plane of the upper floors of the historic
row; that the proposed addition will not project further than other rear yard additions within the block therefore,
will not diminish the central green space; that the simple massing of the proposed addition is in keeping with the
massing of existing additions in this block; and that the proposed rear yard addition will retain a scale and
character in keeping with the block, and will not eliminate the presence of a rear yard. Based on these findings,
the Commission determined the proposed work to be appropriate to the building and the historic district, and
voted to approve this application.

However, In voting to grant this approved, the Commission made its determination subject to the condition that
two sets of the final signed and sealed Department of Buildings filing drawings be submitted to the staff of the
Commission for review and approval.

Subsequently, the staff of the Commission received drawings G101, G102, HC101, D101, A101, A102, A103,
A201, A501 and A502, dated January 23, 2007, prepared by DeLacour and Ferrara Architects. The Commission
reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on
this and the above findings, the drawings have been marked approved by the LPC with a perforated seal and
Certificate of Appropriateness 07-6727 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
