Dutch West India Company LLC 378 Columbia Street Ground Floor Brooklyn, NY 11231 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 19, 2006, following the Public Hearing and Public Meeting of June 6, 2006, voted to grant a Certificate of Appropriateness to construct a new building at the subject premises, as put forward in your application completed on May 11, 2006; and as you were informed in Status Update Letter 07-2294 (LPC 06-7489) issued on September 25, 2006. The proposal, as approved, consists of the construction of a four-story building with a penthouse, featuring red brick and zinc panel cladding, with a zinc cornice, multi-light casement windows, a zinc panel-clad recessed vertical bay featuring single-light tilt windows, a projecting zinc-clad canopy at the recessed entrance door, and a standing-seam zinc clad penthouse and cement stucco and zinc panel cladding, single-light casement windows, and balconies at the rear facade; HVAC equipment and flues at the roof, the creation of a new areaway, featuring an excavated light well and a new simple black-painted picketed areaway railing with gate, and an excavated ten foot deep terrace at the rear yard. The proposal, as originally presented, conisted of a uniform fenestration pattern at the front facade; a visible railing at the roof; an understated entrance; an overall height increased by four feet; and a more narrow recessed vertical bay. The proposal was shown on presentation boards consisting of a historic district map, block plans, current condition photographs, streetscape photographs, photomontages, renderings, and elevation, section and plan drawings labeled LPC 1 through LPC 15, LPC 15a, and LPC 16 though LPC 20, dated received September 19, 2006; and drawings LPC 1 through LPC 15, dated May 9, 2006, prepared by Fractal Architecture PLLC; all presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission noted that 268 Cumberland is a vacant lot; and that the streetscape is mainly comprised of four-story brick rowhouses. With regard to this proposal, the Commission found that the construction of a new building on this vacant lot will create continuity in the streetwall; that the overall height of the building is consistent with the heights of buildings on the block; that the proposed fenestration is in keeping with the punched window openings typically found on historic buildings in this historic district; that the graduated scale of the windows at the front façade creates a hierarchy of fenestration, which is in keeping with the fenestration patterns typically found on rowhouses on the block; that the recessed vertical bay breaks down the scale of the building on this wide lot, thereby allowing it to relate to the predominant rowhouse scale of the buildings on the block; that the recessed vertical bay allows the building to relate harmoniously to the adjacent smaller church by providing a visual relief between the two structures; that the clearly defined areaway and fence creates a uniform treatment to the approach of the building in relationship to the neighboring rowhouses and the streetscape; that the clearly defined areaway with a simple metal fence allows the recessed base to engage the streetscape; that the canopy over the door will give the building a pronounced entrance; that the proposed brick, cement, and natural finish zinc panels relate well to the materials typically found throughout the streetscape and the district; that the hipped roofs of the penthouse will be perceived as flat roofs from the street, and therefore will relate to traditional roof shapes on buildings within this historic district; and that the proposed building is supportive of the special architectural and historic character of the Fort Greene Historic District. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that Landmarks Preservation Commission receive two sets of final Department of Buildings filing drawings, and a CD of the public hearing and public meeting presentation materials. Subsequently, on January 26, 2007, the Commission received a CD of the public hearing and public meeting presentation materials; and drawings A100, A101, A102, A103, A104, A105, A106, A200, A201, A300, A301, A302, A400, A401, A402, A500, A501, A600, A700, A701, A702, A703, C100, C101, G001, G002, G003, G004, G005, G006, G007, G008, G009, M101, M102, M103, M103, M104, M105, M106, M107, M108, M109, M110, M111, M112, P101, P102, P103, P104, P105, P106, P107, P108, P109, P110, S100, S100, S101, S102, S103, S104, S105, S106, A107, S200, S201, S202, S203, S204, S205, S206, S207, S208, S209, S210, S211, SP101, SP102, SP103, SP104, SP105, SP106, and Z001, dated December 18, 2006, prepared by Hernan J. Galvis, R.A. The Commission reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, Certificate of Appropriateness 07-6027 is being issued. PLEASE NOTE: As the approved work consists of subsurface work, the applicant is required to strictly adhere to the Department of Buildings' TPPN 10/88 governing in-ground construction adjacent to historic buildings. It is the applicant's obligation when applying for a DOB permit to inform DOB that the TPPN applies. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
